Doesn't seem to make sense, but I do not know how the law is worded.


Isn't that incorrect to say 'give birth' to a fetus?
Didn't she in fact miscarry since they feel the baby died in the womb?

You know how prosecutors are.  They will spin
the case hard against the accused, while the defense
will do the opposite.  Giving birth sounds a lot
worse that miscarrying.  The only problem with this
logic, though, is they don't seem all that eager to
charge her.   It is peculiar.

Homosexual acts of any type cannot produce children...

...which in my mind, weighs heavily against claims that homosexuality is a genetic predisposition.

I do think that overwhelming public disgust will prevent incest from becoming legal...

Disgust? As in fisting, but-banging, tossing one's salad, smokin' the pole?

Nope, this is just another example of the government intruding into the bedrooms of those exercising their alternate lifestyle. The Supreme Court has spoken & may God have mercy on their souls.

In California, first cousins can legally marry. The law has been on the books for nearly a hundred years.

Well the other end of the spectrum is legislating who should be on top...


The problem is also that the other means by which one keeps society in check (without legislation) have also been dumped, such as public scorn, shunning, etc. [Liberal]people may not like the idea of friends and neighbors being part of controlling public behavior, but without the public frown, there is little to stop people from going "too far" in stretching the boundary of what was once considered decent and moral behavior.

Giving birth sounds a lot worse that miscarrying.

I dunno...it seems to me that (give birth) is a less "offense producing" description, as miscarriage brings with it visions of death and pain and blood.
However, it's more likely just a result of the poor language skills of whomever made the statement.

Yeah, it's a minor thing. What is outrageous is that one party to consensual incest be charged and the other one not.
