In light of Toady's Supreme Court ruling will the incest law stand? Incest is a felony.

Actually some states have toughened incest laws. As an example Arkansas this year upped the felony status of incest from a Class A felony to a Class Y felony (same felony level as rape). North Carolina also recently closed the "incest loophole". The problem is many states have laws that treat incest as a lesser crime than rape or abuse of a minor, due in part to old laws & statutes designed to discourage marriage among relatives, which have the effect of creating a loophole for child abusers within families.

How dare the state legislature pass laws against what individuals do in the privacy of their home! Have they never heard of the penumbra of the Constitution?

That's not to say of course that some sicko might think adults can do what they want in the bedroom with a relative. However, I do think that overwhelming public disgust will prevent incest from becoming legal, or one can at least hope :)

BLOOMINGTON - Sheriff's detectives investigating the circumstances behind a stillborn fetus found in an alley arrested a 17-year-old boy on suspicion of committing incest with his sister, the baby's mother.

The District Attorney's Office will determine whether the 22- year-old woman who gave birth to the male fetus also will be charged with incest, sheriff's officials said.

Incest is a felony.

"They're going to submit the criminal case and the coroner's report to the district attorney and let the DA determine if any charges will be filed,' said Cindy Beavers, spokeswoman for the San Bernardino County Sheriff's Department.

Children playing in an alley in the 18400 block of Ninth Street discovered the fetus, estimated by detectives to be three to five months short of full term, at 7:24 p.m. Monday, Beavers said.

Sheriff's deputies said the stillbirth had occurred more than nine hours earlier and that the mother, Jennifer Alvarez, left the fetus in the alley without telling anyone.

The 17-year-old, whose name was not released because of his age, was booked into Juvenile Hall.

County coroner's officials determined the fetus died of natural causes in the womb.

Relatives said they had no idea about the pregnancy and were even more shocked to learn of the alleged incest.

"I don't know what was going through her head,' said Roseanne Granillo, the siblings' aunt. "It's just shocking to me that she just had a baby in the back like that.'

Granillo said her niece and nephew had been in separate foster homes most of their lives. She said she began taking care of her niece three years ago when she left the foster care system.

Her niece and nephew saw each other twice a year when he received a pass to visit family members, Granillo said.

Family members discovered blood around the house Monday, but it wasn't until later in the day that Alvarez told them she had given birth, they said. She was taken to Kaiser Permanente Medical Center in Fontana fpr treatmment and later released. She remained at her aunt's home in the late afternoon.

Granillo, who talked while cleaning up behind the home on Tuesday, said the incident has been a strain on her family.

"You hear about a lot of things out in the world, and you don't expect it to happen to you,' she said. "It's just shattered my family.'

These kids need help, not prosecution. The screwed up government messed up their heads by keeping them in separate foster homes most of their lives, allowing the boy a "pass" to go visit his sister twice a year. Now the same screwed up government wants to prosecute them for having an abnormal sibling relationship. Well, gee, I wonder why they don't have a normal sibling relationship?

They are both at or above the age of consent, so this isn't a case of sexual exploitation of a helpless child. The government's further involvement should be limited to paying for these poor messed up kids to visit a shrink regularly.

It is the orderly structuring of the family that is the reason why it is frowned upon throught the world, disgusting behavior aside. A father having relations with a daughter, threatens the status of the mother. Families cannot withstand this upheavel, with good reason.

I think there should be a legal loophole for the parent who learns that their child is being abused. They should be allowed to take the matter into their own hands to deal with the perpetrator, family member or not.
