Your point? If it is that many from diverse origins have come to the United States and adopted those ideals and ideas, then I agree. My point is that the arivees of diverse origins should not try to remake this country in the images of the places they left because this country was more attractive.

I do not have the briefs handy. Why don't you read them yourself?

Well, thanks for not answering my question

Yep!

The blacks and libs use the "one drop" formula.

But For Native American (many of us) they require a substantial provable % for government programs or even tribal recognition.

14th Ammendment does not "equally apply" to blacks and those with native American blood?

Did the US government maintain "plantions" as long as "reservations"?

Think about the differences in time; free blacks were serving as US soldiers while killing whole Indian villages including women and children that were confined to reservations.

Think about that.

Let them deny that.

It will be interesting to see how this applies to private law schools and universities.

Note that the "point system" is struck down and not necessarily the "decision process", i.e. race can still be considered at the graduate and undergraduate level.

In this sense the point system could be considered more fair since it would be theoretically possible to overcome the race point bias with intelligence scores, grades, admission statements and community service. Instead an admissions committee now can just decide whatever composition of ethnicity they want and go from there, and there is nothing stopping this at the undergraduate level.

I am genetically unique having no twin or genetically identical sibling. Does that make me a minority of one?

These decisions also apply to State universities. The private colleges are giving advantages to minorities but still welcoming outstanding students first.

IMPORTANT: presently ANYONE who want to become a lawyer can fine an acredited law school to accept them. These people may not be able to enter a selective school but they will get in somewhere. All law graduates have a portion of the bar exam on the same blind footing as all other applicants for a particular state in order to actually practice. Perhaps this factored into the opinion.

I'm a 'tweener. My wife's 40th birthday is this Sunday (she's a little upset about it, even though she's still quite beautiful and is often mistaken for 30).

The war has been a-brewin' for quite some time. John Fonte wrote an excellent piece called Why There is a Culture War that really got the left's knickers in a knot.

John uses Gramsci and Tocqueville to illustrate both sides of this war. According to John, Gramsci believed that in order for Marxism to succeed it was necessary first to delegitimize the dominant belief systems of the predominant groups and to create a 'counter-hegemony' (i.e., a new system of values for the subordinate groups).

That's what's been happening for some time now, as the left has invaded and taken over the government and our institutions.

John and I exchanged several emails before I came to the conclusion that since it took a long time to turn the ship that is this country, it was probably too late for anyone to make any significant attempt to turn it the other way.

Sorry, but GW Bush is part of the problem, not the solution. My Dad has lately been saying that he's happy he's 66. I've been saying lately that I'm happy to be (almost) 40.

My wife keeps saying that every generation says that civilization is sliding down the crapper. I told her the reason for that is that it WAS sliding down the crapper all of that time.

Biblical types (me included) would have to say that it is so written, so it was bound to happen anyway. We have no children, but I have nieces and nephews and friend's kids I treat as my own, and I worry about them.

We're fortunate enough to have been successful capitalists, so I can at least leave them all a pile of cash when we shake off this mortal coil.

Sorry that you have to clean up our mess.

Just read Gutter v. Bollinger, all the justices agree that Powell's opinion in Bakke, strict scrutiny should apply to racial classifications in university admissions policies and the classifications should be upheld only when it is met to serve a compelling state interest. Furthermore, Rhenquist, Scalia, Thomas and Kennedy agree with Powell that diversity is a compelling state interest.

I understand all that.

But I agree with none of it. IMO (which counts for blessed little, as I'm not part of SCOTUS, beyond my own sense of well-being, etc.) any system that is based on race, no matter how tailored, etc., violates equal protection - period. Preference (read "bias" or "discrimination") done with "strict scrutiny" is still discimination - it's just sanctioned discrimination.

Not the first time SCOTUS got it wrong, again IMO, but for now that will be honored as the law of the land - until the next test case and the next roll of the legal dice with, hopefully, a more conservative judicial panel.

Supreme Court: Racism against whites Constitutional.

Black is white and up is down according to the Supreme Court. I am sad for America. New title: Liberal BS wins over law.

Where is it stated in the Constitution that gov't may discriminate in favor of minorities over whites? I can't find that sentence anywhere. The five libs should face criminal charges.

Maybe he doesn't understand his gift or what it's saying..... or his interpretive skills are failing him apparently.... Note that he has to use cut/paste to try and express a point. He can't do it in his own words.....

You were questioning my certainty that President Bush (via Solicitor General Ted Olsen) argued IN SUPPORT of the lawsuit AGAINST the U of M. You inquired yet another time if I was sure. Then aristedes pointed out that it was indeed an argument in support but he doesn't think it wasn't good enough. Now you cite the very thing to which I was referring and state that it's not good enough, and do so without any apology? Don't you know Rush ALWAYS corrects himself when he has misquoted, misjudged or misunderstood, and that he puts the retraction at the top of his show?

Luis...'racial diversity' is Marxist prattle. I think you know that the leftist definition of racial diversity is completely different than the uniquely American 'melting pot' idea that doesn't value group identity over being an American.

So, please, take your name calling, race baiting class warfare drivel somewhere else, okay?

PS = If you want some enlightenment, read John Fonte's Why There is a Culture War. Maybe you'll learn something.
