Ultimately, this will mean that the schools will have much larger latitude to do what they want. In other words, if they feel that they need to provide greater "diversity," they can go grab up whoever they want, standards be damned.

Bottom line, this could bite a lot of folks in the ass in the long run.

We REALLY need to get some more conservatives on the bench. I hope this is a bit of a kick in the pants to Frist and company to get off their collective duffs and get Estrada and Owen confirmed...

The 2nd decision limits how extreme the racism in college admissions can be.

Exactly right. Taken together, these two decisions tell America you may descriminate against whites, just don't do it overtly.

If the compelling governmental interest is racial diversity, I shouldn't think it matters what kind of black one is, where one hails from, one kind is as good as another in creating racial diversity.

Please consider how every decision on every issue between now and election day must be viewed thru the prism of 2004.

Exactly right! By Bush not being especially vocal on this issue, it becomes a non-issue in the campaign. College admission policies are now being set by the former wild-eyed Marxist untenured professor from the sixties who is now the college president. AA is not going away, even if the Supremes say it has to.

This just affects admissions. Nobody's giving minorities any extra points on exams (with the possible exception of athletes). Even if some unqualified boob makes it out of the law school, you don't have to hire him to take your case. It's sad, because when I was a kid back in the sixties, I heard it said that you should find a woman doctor whenever you could, because she had to be twice as good as a man to be thought half as competent. Now, AA makes the assumptions work the other way.

All these half-raters will end up working for the government anyway, and your qualified attorney will be able to beat their pants off in court. That's what happened in the O. J. Simpson case!

I agree. I would like to have seen both cases go against affirmative action, but the undergrad policy was the more insidious one. The spin by the media is that Affirmative Action has emerged unscathed. This is not true. Things could be a hell of alot worse for conservatives today.

Novak is a registered Democrat in DC, so he could actually vote in local politics.He is not a Democrat at all.

This morning's Supreme Court decision on AA should serve as a reminder of how vital it is to get Bush's judicial nominees confirmed in the Senate. No doubt, the RATS are probably jumping for joy at the decision. The Senate judicial confirmation hearings are going to get even nastier. Plus, expect the likes of John Kerry, Howard Dean, and company to be ranting about how the AA decision is proof that African-Americans are merely 1 SC Justice from slavery. In 2004, the RATS will be attempting to race-bait their way back to power.

He did NOT argue (because he had been ordered not to) that racial diversity is not a compelling interest that can justify practising racial discrimination if it is narrowly tailored.

Actual proof of your allegation?

In the end another sad day for African-Americans -- continuing to get hand outs only perpetuates the system and they are not advancing. John McWhorter had it right - separtism, victimology, and anti-intellectualism has kept them down and this will not help them up.
