"Thou shalt not do any work" is what the Bible says when it comes to the Sabbath Day, but now a legal decision could mean no play as well.
In the first-ever ruling of its kind in America, Oregon's state court of appeals says the state's high school activities association must make a reasonable effort to accommodate religion when scheduling sports tournaments.
The Oregonian reports that the case was brought by the Portland Adventist Academy because its basketball team was barred from participating in the state championships.

The decision, however, extends beyond merely basketball, the paper said. It also includes 80 other state championships in 16 different sports and activities organized by the Oregon School Activities Association, or OSAA. Other competitions include dance, cheerleading and music events.
The Portland Adventist Cougars were prevented from participating in Class 2A tournament competition in March because the team doesn't play from sundown on Fridays to sundown on Saturdays. That's when Seventh-Day Adventists observe the Sabbath.
The Cougars were this year's Northwest League champions.
The activities association says that teams must agree to play all scheduled games to participate in the tournament, but the appeals court ruled that requirement was improper when a team's religious commitment is also at issue.
"For the OSAA to require a person to choose between a religious obligation and participation in a covered activity, without first attempting to find a reasonable accommodation for the conflict, is to act in a way that is fair in form but discriminatory in operation," said the three-judge appeals court panel, in its unanimous ruling. "It is therefore illegal discrimination."
Attorney Charles Hinkle of Portland argued the case on behalf of the students for the American Civil Liberties Union.
"This is the first time that any court in the country has ordered a state high-school activities association to accommodate students' religious beliefs," Hinkle told the paper. "The OSAA was giving short shrift to very important values in our society mainly the values of sincerely held religious beliefs of a substantial segment of our society."

But Tom Welter, executive director for the OSAA, said the appeals court ruling doesn't change the fact that it's unreasonable to expect his organization to accommodate every religion in scheduling.
"We're confident that when (the board) reviews the record and all the requested accommodations, they will determine that those accommodations place an undue burden on the association," he told the paper.
And, says Jonathan Radmacher, the OSAA's attorney, there are legitimate reasons why the association could not accommodate the Cougars' beliefs, though he did not specify them in an interview with the Oregonian.
The OSAA can appeal the ruling to the Oregon Supreme Court, and its lawyers are reviewing the appeals court decision to determine whether further legal action is needed. Also, state schools superintendent Susan Castillo is consulting with the state attorney general's office on its next step, according to Gene Evans, an Oregon Department of Education spokesman.
The Cougars went undefeated in their league in 2000, but were unable to participate in tournament play that year because the OSAA refused a team request to accommodate its Adventist beliefs. Student players then appealed to the state Board of Education, but two years later, the board backed the OSAA. The Adventist academy then took the case to the court of appeals.

The OSAA agreed in 1996 to alter game schedules if necessary. The Cougars did not need to alter scheduling that year because they won the state title in a game that began after sundown Saturday.
The association changed its policy the following year, and the school filed suit in U.S. District Court. But the federal court ruled the association did not have to accommodate religious beliefs in tournament scheduling. The issue then lay dormant until 2000, when the school again qualified for state tournament play.
Currently, other states are considering the same issue, including Washington and California, said the paper.
In the Ten Commandments, the Sabbath was made the focus of the fourth mandate: "Remember the sabbath day, to keep it holy ... thou shalt not do any work ... For in six days the Lord made heaven and earth, the sea, and all that in them is, and rested the seventh day: wherefore the Lord blessed the sabbath day, and hallowed it" (Exodus 20:8-11).
To accomodate every religion, schools would have to bar activities on Fridays, Saturdays, and Sundays. Of course, they should also avoid Wednesdays because many Baptist and Chirch of Christ churches have services on Wednesday, as well as Sunday. And many other Christian churches hold choir practice on Thursday nights, so that night is out.
My reckoning shows that we have only Monday and Tuesday left to hold sports events. Of course the secularists will object to school games and contests on Mondays because that would interfere with Monday Night football -- another type of religion.
So, it looks like everything will have to be planned for Tuesday night which will surely prevent a student from participating in more than one activity! ;^
