Indictment expected in the near future

NEW YORK, June 3 — Domestic taste-maker Martha Stewart is the target of a federal criminal probe, her company, Martha Stewart Living Omnimedia Inc., said Tuesday.

A FEDERAL PROSECUTOR intends to ask a grand jury to return an indictment against Stewart in the near future, the company said in a press release.

This is probably already done. Indictments seem to be announced a few days after the fact.

Martha Stewart's company reports criminal investigation

NEW YORK -- Federal prosecutors are seeking a criminal indictment against Martha Stewart "in the near future," her media company said Tuesday.

Stewart has been under investigation on suspicion of insider trading involving shares she sold of biotech company ImClone Systems Inc. in December 2001.

The statement from Martha Stewart Living Omnimedia Inc. said Stewart's attorneys told the company that Stewart is the target of a criminal investigation by the U.S. Attorney's office for the Southern District of New York and that a civil complaint by the Securities and Exchange Commission also is expected.

The statement didn't elaborate on the possible charges.

The company said its board of directors has been planning for a number of possible contingencies, is evaluating the current situation and will take action as appropriate.

Federal authorities are investigating Stewart to learn if she sold ImClone shares because she had insider knowledge that the Food and Drug Administration was going to reject the company's application for its new colon cancer drug. Stewart has denied any wrongdoing in her ImClone sale.

A message left with Stewart's attorney before office hours was not immediately returned.

The U.S. attorney's office had no immediate comment when reached Tuesday morning.

This is getting to be like the clinton scandals.... and I have a feeling, unfortunately for justices' sake, it will yield the same results. A big zero.

I have a gut feeling she's not guilty. I think she's made some enemies along the way. Martha is too smart to be caught doing something so stupid.

My cousin's husband is a lawyer with the SEC. He said she was going to be indicted and he said this many months ago. I told him I'll believe it when I see it but....

As did the FDA official who improperly leaked the information to Imclone in the first place.

Martha Stewart was not an employee or executive of Imclone. She got a tip about the company and made a rational decision to sell her stock. This should not be a crime.

Naughty. Get in line. I'm hot for martha. Though shes blimped out - I couldnt beleive how big she was about 6 weeks ago. I hate it when that happens.
