God kept out of EU constitution

France leads charge to pander to Islamic immigrant populations

The draft European Union's proposed constitution leaves out mention of God and Europe's Christian roots, despite strong pressure from conservatives and the Vatican, and amid fear of alienating Islamic immigrant populations, reports the Italian news agency ANSA.

The long-awaited preamble to the document used the words "spiritual", "religious" and "humanistic" to describe Europe's heritage and references traditions in Europe "nourished by the Greek and Roman civilizations," but makes no reference to the deity.

The question of whether to include God in the EU's first-ever constitution has been a subject of intense debate in recent months as drafters attempted to cobble the document. Its purpose is to build cohesion within the EU as it expands eastward and grows from 15 to 25 member countries next year.

All current members are formally Christian states, but most make no reference to their Christian roots in their respective constitutions and keep church and state separate.

But many of the 10 countries due to join next year, led by the largely Roman Catholic Poland, wanted "Christian values" mentioned in the constitution.

Poland is due to hold a referendum June 7-8 on whether to join the EU. Cardinal Jozef Glemp, the Polish primate, has said he supports EU entry "but only with God," reports Agence France-Presse.

Likewise the Roman Catholic primate in Hungary, Monsignor Peter Erdoe, is clear on what the union should be founded on.

"Without Christianity, the heart of Europe would be missing," Agence France-Presse quotes Erdoe as saying.

Pope John Paul II also lobbied European leaders for "a clear reference to God and the Christian faith to be formulated in the European constitution."

Former Irish Prime Minister John Bruton formally proposed including a mention of Christianity. He told EUobserver.com, an independent website based in Belgium, he believes "a greater reference should be made to the fact that many Europeans derive something beyond humanity - this would apply to those who believe in all the major religions."

Secularist countries, led by France, contend pluralist modern Europe is beyond the need to reference religion, according to ANSA. Leaders also stressed a reference to "Christian values" would make it more difficult to accept a mostly Muslim country such as Turkey.

In an editorial, Scandinavia's largest daily newspaper, the Swedish Aftonbladet, said referring to Christian values in the constitution and placing them above other values would be a "huge mistake" because it would "exclude groups and raise new walls."

ANSA reports several countries were nervous about creating resentment among their large Islamic immigrant populations.

"We are very glad a reference to God has been left out, it would have created unnecessary barriers in Europe," Terry Sanderson, vice president of the UK's National Secular Society, told EUobserver. "Europe has to be secular for it to be really unified."

Giscard d'Estaing, a former French president and the head of the Convention on the future of Europe, the body charged to draft the constitution, earlier indicated a compromise was possible by having the preamble mention religion. There is no mention of God or religious values in the main body of the text.

Penning the article himself, Giscard dashed the hope of compromise he had raised.

The 105 convention delegates will debate the latest draft starting tomorrow. The individual EU governments will then have the final say.

Why didn't the EU just copy Communist Manifesto for their constitution? It would've saved all the hard work spent on this document and said virtually the same thing.

yep, the really ironic part is that their defiance is entrenching the Trojan Horse even further in their own land ... with France and England having nuclear weapons though, I don't relish the possibilities with regards to potential future leaders ...

I don't think God is in the U.S. Constitution either. God is in the soul of America. Putting God into the supreme law of the land will only get you places like Afghanistan. So I'm really sorta glad he isn't in it.

THE EU’s draft constitution is now available virtually in its entirety, complete with helpful annotations by Valery Giscard d’Estaing and his team. Like the Maastricht treaty, it is a tediously repetitive document. Like the Maastricht treaty, it is essential reading for business people, who have learnt the hard way to see through the British political delusion that EU treaties do not mean what they say.

In the political knockabout, the Opposition naturally focuses on the new powers being assembled collectively, particularly on foreign affairs and defence. Leaving that aside, Peter Hain, our man on the drafting commission, insists that it has really been just a tidying up exercise to cope with enlargement.

For business, however, that is just the problem. By limiting changes and leaving all the main relationships intact, the constitution will rule out any fundamental reform of the way the Union works for many years ahead.

One small clause towards the end of the document illustrates the difficulty. The draft contained a modest suggestion that European Commission regulations, delegated to Brussels by framework laws, might be given time limits so that the silly, needless or unreasonably costly ones that make the headlines can be weeded out after a few years without too much fuss.

Only regulations that were still needed would be kept and reasserted. This was a small attempt to introduce sunset clauses, into the delegated regulations made by bureaucrats. What we really need is for sunset clauses to be built in to all EU directives so that they automatically lapse after a period of up to 20 years. They can then be recast to meet the new needs of the time. Far from this happening, however, a flood of objections has caused even the idea of sunset clauses in bureaucratic regulations to be dropped. It would, the objectors insisted, introduce an unwelcome degree of uncertainty.

The difficulty of changing European laws once they are made is one of the EU’s worst features for business, where continuous change needs a flexible legislative background. So far, most of EU law is actually about commercial matters. Yet it seems harder to update than the US Constitution. Trying to change company law in the UK is laborious enough, as reformers are just now discovering. In the EU, it seems virtually impossible, not least because only the Commission may propose legislation to the Council and to the European Parliament.

Some reforms in accounting, for instance, could not be made because they fell foul of an obsolete EU Directive. Only a new Commission initiative mandating International Accounting Standards has accidentally saved the day.

The draft constitution also enshrines the continental social model in ways that are now plainly out of kilter with the free market economies. The sort of reforms that Gordon Brown, among many others, wants to see in Germany, Italy and France, will be made that much harder. The constitution insists on incorporating the old social model of collective representation of business and trade unions into its basic laws as well as tripartite advisory councils. Social charters and human rights legislation, which has become a bane of businesses big and small, will also be set in constitutional aspic.

A generation of British ministers has called for reform in the way the EU operates to increase speed of action, improve efficiency, save waste, dilute agricultural and trade protectionism and generally make our Union more responsive to our needs. All that can now be forgotten.

Of course God is kept out of the EU. Europe is metric, for cryin' out loud. If God had meant for us to use metric, Jesus would have had only ten disciples.

Yup, which doesn't have the force of law, but is the document that describes to the world who we are and what we stand for, lest anyone forget. I don't think any Constitution could come close to making such a statement.
