What happened at 310 W. 143rd Street was meant to be the end result of a drug investigation based on confidential information from a police informant. But it is now among the most tragic errors of the NYPD.
Lucille Ross, Building Resident: "She was such a lovely person. If something was to happen with her like this, I want to know why."
The search warrant was apparently issued for apartment 6F in the multi-unit building. It was the home of Alberta Spruill.
Today Police Commissioner Ray Kelly said it was based on what investigators thought was reliable information. But it all turned out to be a terrible mistake.
Police Commissioner Ray Kelly: "Entry was made by officers from our Emergency Services Unit who used a flash grenade during that entry. Once inside the officers found the occupant, a 57-year-old woman, identified as Alberta Spruill. She was briefly handcuffed while police conducted a cursory search of the apartment. The patrol captain then entered, and saw that the apartment did not match the description given by the informant, and immediately ordered that the handcuffs be removed."
The commissioner said Ms. Spruill soon told officers she had a heart condition, and then complained of chest pains. EMS was called to the scene and administered aid. But Ms. Spruill died a short time later at Harlem Hospital.
Commissioner Ray Kelly: "On behalf of the entire New York City Police Department, I want to offer my condolences and sympathy to the family of Alberta Spruill. I also want to offer my apology. This is indeed a profound tragedy."
Calvin Alston, Building Resident: "We're all just devestated. Really devestated. Because this is a woman that got up and went to church every day ... went to work every day. And we're all just devestated that this would happen to someone like this."
Police Commissioner Kelly did say a "flash grenade" was used at apartment 6F before officers entered. It may be the use of that flash grenade broke procedure. The ESU lieutenant who used it is now on administrative leave pending the investigation. Those grenades have been used 85 times this year.
And NYPD tells us only four mistakes out of 1,900 search warrants have been made this year. The investigation of this tragedy continues.

This lady must have been health wise a walking time bomb. I agree. It is her fault. There are no innocent victims in the drug war. There are the druggies who deserve to be shot, and the non-druggies whose reponsibility it is to stay in tip top shape in case the cops bust down their door by mistake. I know that I work out every day in case of such an eventuality. This woman got what she deserved.

I think those that are pro-drugs want the assumption out there everyone else is extremely stained with human flaw so their vice can been seen in some acceptable light.
Worked for Clinton to some extent and those for illegal drugs pull the same bunk here today.
Sad stuff, better left at DU where it belongs!

That is a special effects grenade, not a gun. Yeah, you're right about that. These things just make a little pop and are only intended to alert the residents that an entry is in progress. Not much more than a very small firecracker really, couldn't hurt anyone even if they were holding it in their hand when it went off. Most certainly couldn't alarm someone enough to cause a heart attack.

The van Dams are in the company of doctors, lawyers, stock brokers and even members of law enforcement who furtively get high in their garages and on their decks, all the while terrified they'll be found out by their neighbors, employers and children.

I think you've realized you have no arguments based on logic or evidence, so you're reduced to baseless insinuations that your opponents are drug users.

I'm not establishing a fault with her, it obviously belongs on the backs of the illegal drug mutants that brought them there to begin with.
But, her health is an issue in that if this was a destructive device, law enforcement wouldn't use it in all likelihood.
I mentioned that this device is used in public crowds to break them up without incident. So you have to figure at the rather young age of 57, the poor lady likely had a pre-existing health issue not typical in most people.
If this device had this result on a typical basis, they would pull it as a tool and as I mentioned earlier, this will cause a needed review and perhaps it should and will be pulled from future use. We will see.

If the cops broke into your mother's house looking for a murderer and she had a heart attack, would you blame the murders or the cops? Most people would be pretty ticked off at the cops. But you may be different, you seem to have a strong affinity for government power.

Correct that- article doesn't say the actual target of the "raid", just the incorrect apartment. Mea culpa.
But the Idaho Constitution prohibits "no knock" warrants, and it seems well anticipated by our forefathers. There's a much needed law for all other states.

My goodness, this thread has degenerated into an anti-drup/pro-drug flame war. Let's get back to this unfortunate lady and the NYPD. My problem with all this is that there apparently are no consequences whatsoever for the NYPD. "We're sorry" -- that's it?
Where's the review board? Where's the televised hearing? Where are the pointed and uncomfortable questions being posed to those in charge of this fiasco while they sweat and squirm in their seats? Where's the recommendations for changed procedures to prevent something like this from happening again?
Mistakes like this might just be forgivable. Mistakes like this that we fail to learn from, that we fail to even care to learn from, are not.

perhaps the knee to her back while they were putting the cuffs on had something to do with it or the fact that while she lay there hyperventilating the cops were trying to justify them being there looking for anything illegal... that takes some time...
