I was just listening to El Rushbo's closing comments and he was explaining a proposed strategy of the President making recess appointments of judges that the democreeps hate; for instance, Robert Bork. Appointing Judge Bork to say, the Washington DC Appeals Court, the judge knowing full well that he would only be there a copuple of months. It would make the democraps go beserk, knowing there wasn't a thing they could do about it. Then broker an agreement that all recess appointments of judgeships would cease if the demolefties would agree to let ALL appointments that have been approved in committee come up for a floor vote. If I am duplicating someone's post, please delete. I thought that this was worth bring up because it is sooo brilliant. What a way to use the talents of retired or never-confirmed conservative judges. Think what could happen if cases that the demons were extremely interested in came before their courts.

I too heard the same proposal.
In my humble opinion, Libs will never allow Bork to get a recess appointment. They are probably in negotiations with the Whitehouse now.
Just the mention of this subject on Rush's show today and heard by all of the "ears" of the Left, probably is causing a such national need of underware changes.

I think Judge Bork was only named as an example, but how can anyone be so sure that this could not happen? Is appointment and confirmation of judges only the province of the left? Are Judges Owen, Pickering, and Estrada not qualified? Don't you think that if an agreement (a precedent) were set, that it would ensure future nominations at least get a floor vote?

Remember, Clinton had some guy in a "civil rights" position for at least a couple years. No reason we couldn't do the same.

The problem is that there have been MANY recesses since Bush went into office and he hasn't done it yet. BTW, I think that a recess appointment term is for one year at which point the appointee may be reappointed by the president, let go, or affirmed or rejected by the Senate.

Judges decide constitutional issues.
There is a conflict between the Senate's power to make its own rules and the President's power to appoint judges, seeing they need the Senate's advice and consent.
The Supreme Court would decide such a case if it were brought to them. It would need a republican decision. In the 5-4 court, Sandra O'Conner is the sore point. If she were to retire and an immediate recess appointment were made, then that court could be presented with a crisis caused by the Senate majority leader. Frist could hold a vote of the majority Republicans saying the constitution does not require a super-majority for their approval; only a majority. That would be a crisis for the Supremes to decide.
O'Conner out of the picture and another strict constructionist and you might just win a decision that says the Senate cannot block votes on presidential appointments using supermajority requirements.
Or you could lose.

My understanding is that a recess appointment lasts until either the position is filled (ie Bush's nominations go through) or Bush's term is up. In other words, they are in until the senate knocks off the filibuster bovine feces or 2004. And even in 2004, Bush could reappoint them through 2008.

Actually Bill Lann Lee received a recess appointment during the August recess of 2000 just months before the Clinton Presidency was to end. He served the early time from 1997 as 'acting Assistant Attorney General'. The recess appt removed the 'acting' from his title and gave him another notch for his resume.....
Any judicial recess appointment would expire with the end of the 108th Congress unless confirmed by the Senate...

Article II, Section 2, US Constitution...
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.
Any recess appt expires at the end of the congress session in which it was made...
