Bar owners group to sue state over new anti-smoking law

Bar and tavern owners will sue the state to overturn the no-smoking laws that take effect on July 24, said Scott Wexler, executive director of the Empire State Restaurant and Tavern Association.

He's waiting for official notification from his board to initiate a lawsuit, Wexler said. Once that happens, he anticipates that it will take 45 to 60 days to put the suit together, he said.

On March 26 the state Senate and Assembly approved legislation banning smoking in bars and restaurants. Gov. George Pataki signed the bill into law later that day.

All of the Albany, N.Y.-area's Democratic legislators supported the measure, as did the area's Republican state Senators. The region's Assembly Republicans voted against the bill.

It's too bad they couldn't approach these kind of issues with a little bit of balance. In my city they determined balance as declaring your establishment either "a smoking establishement" or "a non-smoking establishment".

They make it pretty apparent that their definition of "balance" is different from most.

It's just an opinion, but I think this has come from people whining about smelling smoke - whether it's harming them or not - they simlpy don't want to smell it. There are definitely worse toxins in the air that need to be controlled......

It was Bloomberg AND Pataki.

Bloomberg pushed the anti-smoking law through in New York City. Pataki signed the law that was pushed through in the WHOLE STATE.

BTW...something's VERY fishy about how fast this legislation moved through the legislature. No public announcement of the impending vote, no debate on the floor, and no opportunity for the public itself to address the legislature. To make matters more interesting, remember that Pataki has already given a hand job to the Hospital Workers' Union in the form of a new cigarette tax (he needed their support in the last election) -- and they are STILL squawking for more!

I tell you, something is REALLY rotten in Denmark. I have an appointment w/my local state senator next week. I intend to get to the bottom of it, or he is going to get VERY sick of seeing my face in his office.

PS: Oh, I forgot...as far as I know, they are late AGAIN with the state budget. Guess they had nothing better to do than spend their days tap dancing on the remnants of the Constitution & stealing my money from me.

Well how do you propose we all share the responsibility of gaining a healthier nation? Through governmental laws (coerion)of course which is exactly what the Nazis did.

Really??? Are you paying for my health insurance?? If you are please let me know so I can arrange that instead of them taking money out of my paycheck every month I can have them send the bill directly to you.

The notion that smokers are somehow costing society extra money is simply ridiculous.

For one we pay more in taxes.

Second even if we quit believe it or not we still won't live forever and we will still die "Costing" Society

Third we supposedly die sooner so we don't collect as much social security, medicaid, etc as non-smokers.

So in fact I am paying for you.

And the notion that you are somehow a more responsible citizen than me is also a bunch of tripe. Do you eat meat, Eat Junk food, drive an SUV, Exceed the speed limit, Drink Soda or Coffee, Drive a snowmobile, Own a firearm, Order supersized value meals or have a high BMI, if you do any of these things (or a lot more I left out) than you are an irresponsible citizen but don't worry there is already moves being taken by activist and people in the government who know how to live your life better than you to help/coerse you into being a more responsible citizen.

Don't forget they also took advantage of the start of the war with Iraq and snuck this through when nobody was paying attention.

And speaking of the Budget and Hospital Workers' Union. No the budget hasn't been passed yet and apparently after all those obnoxious commericals we been hearing on how if budget passed as is old people will be thrown out into street Pataki and the legistators caved and despite the $10 billion state deficit and double digit property tax increases they are going to increase spending by $2 Billion. They are just figureing out how to pay for it (i.e. which of our taxes to raise higher). Wonderful huh? Even California will reduce it's spending but not New York. Thanks Pataki. The only good news is people in this state are finally starting to see Pataki for who he is and his poll numbers are starting to tank.

BTW. I with a freind who is a Republican town supervisor who is also pissed at this law was supposed to meet with my Senator last Friday but she instead decided to bolt to Myrtle Beach for the weekend and cancelled. She has been keeping a low profile up here but I will get her eventually. Actually Pataki brought a summer home up here last year and makes a lot of appearances in the towns around here, I hope I run into him because he will get a ear full.

I will have to give credit to my Assemblywoman (Sayward) she voted against it and has been rallying against it. She wrote an excellent article in one of our local papers (No website or I would put a link)on how bad this law is. Especially on one nasty little provision in the bill that nobody is talking about. Did you know that if you hire a caterer for a private party or whatever at your house you can not smoke in your own house!!! Even if you have the party outside you can not smoke if you put a tent up if you hire a caterer.

I did NOT know about the caterer situation. I have the full text of the law here (Senator Flanagan sent it to me). It is an onerous little piece of trash, and I will read it again more carefully this time and find that provision. Flanagan's gunna get an earful about that, too.

Also, I forgot about the "let's pass this law the day after the start of the war so no one will notice" business. Disgusting.

Oh really? I take that to mean that you are now going to hang out in the old "drive-by" bars/restaurants where the good ole boys hang out in. The bars/restaurants where nobody gives a rats ass who does or doesnt smoke. The bars/restaurants in the areas where you would crap your pants if you had to stop into one.

No? You mean that you are not going to help fund their losses in revenue due to the threat of being closed down due to some smoke-nazi such as yourself who is looking for bar/restaurant violators stopping in and reporting them? Whats the matter, aren't those bars good enough for you?

But hey, they're "drive-by" bars anyway so why should you care? You got your own little smokefree bar of your own......... Stay there and stay out of mine otherwise the garbage collectors will complain about overweight trash in the alley!

Exactly, I cant count the number or times I walk into a resturant bathroom and see everyone in there smoking. Heck, I join em sometimes. They can't stop everything.. but they can try, and fail.

Most clubs or bars I have been to in San Fran flat out ignore the law.

AMEN!!! I have absolutely had it up to my ears with being micromanaged by the government, whether it be local, State or Federal. Some days it feels as if they are intentionally TRYING to make it unattractive to invest my capital, employ working class people, pay my taxes and, ultimately, pursue the American dream!

If I post a sign on my restaurant that says, "This is a SMOKING establishment." A potential diner can choose to open the door, or not. It is not his RIGHT to eat at my privately owned place, it is his choice and privilege. What ever happened to:

We reserve the right to refuse service to anyone?

UGH! Are there any suits currently being filed to amend or overturn the current law in FL? I appreciate any insights or information provided!
