MODESTO, Calif. (AP) - Scott Peterson pleaded innocent Monday to killing his pregnant wife and unborn son, as prosecutors filed charges against him that could bring the death penalty.
''I am not guilty,'' Peterson said during a brief arraignment in Stanislaus County Superior Court.
Stanislaus County district attorney filed the charges hours before Peterson, 30, was appeared in the Modesto courtroom. District Attorney James Brazelton said in the filing that Peterson acted ''intentionally, deliberately and with premeditation'' in killing 27-year-old Laci Peterson and Conner Peterson, the couple's unborn child.
Their bodies washed ashore last week about three miles from where Peterson said he was fishing in San Francisco Bay when his wife - who was eight months pregnant - vanished.
The charges against Peterson include the special circumstance that he committed more than one murder, allowing the district attorney to seek the death penalty. Brazelton has not definitively said whether he would do so.
Peterson was arrested Friday in San Diego County because detectives feared he might try to flee the country and was order held without bail at the Stanislaus County jail. He must have gotten that advice from O.J. - However, even O.J. wasn't dumb enough to do some of the stupid things that Scott has done since his wife's murder. The latest, of course, is getting caught next to the Mexico border with $10,000 on the day the examiners were to determine if the remains were that of Laci. So much for caring about your wife, huh?

Subtle distinction, but he really plead "not guilty" which is a far cry from "innocent."
And in no way is he innocent..., but he may be found "not guilty."

The sheriff (or his spokesman) said the one thing Scott Peterson wanted when he was booked into jail was a haircut.
Scott was probably informed that jails do not have barbershops, especially over Easter weekend. He's just going to have to let his hair grow until the barber visits his cell block.

Not to mention that he had altered his appearence and was obviously ready to cross into Mexico which does not allow extradition if the death penalty is an option. Sort of like James Kopp the guy who shot the abortion doctor and then ended up in France which has a similar policy.

So, was Bill Garcia right about the finding cement and tracks near a Modesto canal? Could Scott have gone there first, mixed the cement, implanted the legs (and whatever) and then gone down to the bay? The bodies came back to haunt him.

Not so. Re-read this line from the article about his arraignment:
"Public defender Tim Bazar was assigned to the case after Peterson said he could not afford to hire a lawyer..."
Looks to me like McAllister has decided NOT to represent him after all. Maybe McAllister:
1) thinks scott/family a risky client since they have consistently ignored his advice to keep their mouths shut
2)thinks he's guilty (not that something as trivial as guilt makes an atty less likely to defend someone!)
3)asked for more money than scott/his family had available
What do you think is the reason for him getting a public defender? What happened to mcallister?

According to Liese Wiele (sp?) on FOX a little while ago, this may have been the lawyer's way of backing out (insufficient funds) without setting off major alarm bells about Scotty's guilt.
