Are you aware that non-uniformed combatants, like these Islamikazis, are not legally entitled to the protections of the Geneva Conventions and can be executed on the spot, even if they surrender?

They are damned lucky that they are being held prisoner instead of laying face down in a pool of their own blood and brains.

We're being to damned lenient with those barbarian savages, as far as I'm concerned.

Thought shots of their faces were supposed to be off limits at all times. They did the first interrogation in the back of the amtrack, the reporters chased them when the marines ran back to the hotel. Before the marines chased the media back to the stairwell, heard lots of taliking. Arab speaker on MSNBC says the accent of one was Egyptian.

They yelled at the reporters to go down the stairs because they were recording the faces. It was too late we saw them!

I may be wrong but I think they can show a capture but not a "interrogation" once in custody.

I heard it explained once that live coverage of an event in progress is not the same as a purposeful public display by a government of POW'S. (source unknown and I paraphrase anyway)

I heard a journalist on MDNBC today say the marines had to protect him and he was shocked at the discipline of the 20 year old men. They shot when commanded to. They stopped firing when commanded not to. They were calm in the heat of battle and deliberate in their actions. AREN'T WE PROUD??? THIS IS OUR YOUTH IN ACTION!

Absolutely right.

Judge Andrew Napolitano covered the relevant law about this on "The Big Show", when our POWs we're paraded on TV.

During fighting action, and as they are being taken into custody, there is no prohibition against showing prisoners.

You cannot produce them at a later time for propaganda purposes, or put them on public display, or subject them to public ridicule or public interrogation.

If you are talking about the non-uniformed combatants, it is my understanding that the U.S. is according them the same POW status as uniformed combatants.

That is a call that our leadership is making. We are not legally required to do so.

In WWII for example, such freelancers were often executed right where they were captured. They are legally classifiable as spies or clandestine agents.

By the way. The definition of "uniform" in this legal sense refers to an insignia or emblem in plain view, which identifies the wearer to be part of a unit under a nation's military command structure.

You do not have to be dressed completely from hat to boots to be "in uniform" in this narrow legal definition.

I forgot to add that in Afghanistan, we did segregate them.

Uniformed enemy troops were held as POWs and repatriated, whereas non-uniformed Al-Qaeda are being detained indefinately at Guantanamo.

Napolitano explained that although we are treating "foreign fighters" as POWS now, we reserve the right to reclassify them at a later time and treat them accordingly.

They may wind up at Gitmo, and not be repatriated to their countries, like the Iraqis "regulars" probably will be.
