The best we can hope for is to get more judges, and Justices, who understand and will enforce the Constitution. But for now, that is at best a 50-50 shot.

A combination of both, with the "contempt of the people" weighing far more heavily. I wouldn't call it "contempt," however. I think the better term is "ignorance."
We need to stop putting the cart before the horse. The people must know and want the Constitution to be the final word before any reversal of unconstitutional mandates can be remotely possible.
