S. 22: Using The Terrorist Threat To Push The Pre-"911" Anti-Gun Agenda
S. 22, the "Justice Enhancement and Domestic Security Act of 2003,"--an anti-gun wish list--was introduced on Jan. 7, 2003, by Minority Leader Tom Daschle (D-S.D.), and a host of other anti-gun Democrats, including Hillary Clinton (D-N.Y.), Edward Kennedy (D-Mass.) and Charles Schumer (D-N.Y.). S. 22 includes:
Ballistic "Fingerprinting"--S. 22 proposes to require "ballistics testing of all new firearms for sale." The bill would require manufacturers and importers to test fire firearms, prepare ballistics images of fired bullets and cartridge casings, make ballistic records available to BATFE for entry in a computerized database; and store the fired bullet and cartridge casings in whatever way, and for whatever length of time, BATFE requires. If imposed, the measure would move America one step closer to national gun registration.
Expansion of BATFE Firearm Tracing Operations--Anti-gun groups and politicians view BATFE's massive firearm traces database as a necessary building block toward a national registry of gun owners. For propaganda purposes on a variety of issues, anti-gunners also often mischaracterize trace statistics, a practice BATFE encourages by its silence. S. 22 calls for the number of cities and counties participating in BATFE's national gun tracing program to rise, incrementally, to 250 by October 2007.
"Smart" Gun and Gun Lock Requirement--S. 22 would require gun dealers to stock and sell "secure gun storage or safety devices," defined to include not only traditional devices like trigger locks, cables, lock-boxes and safes, but also "a device incorporated into the design of the firearm that is designed to prevent the operation of the firearm by anyone not having access to the device."
Gun Show Promoter/Customer Registration--While federal government studies repeatedly have shown that criminals hardly ever get guns at gun shows, S. 22 falsely claims they often do so and would make it a crime to "organize, plan, promote, or operate a gun show unless that person registers with (BATFE) in accordance with regulations promulgated by the (Treasury) Secretary; and pays a registration fee, in an amount determined by the Secretary." It would further make it a crime "for any person to organize, plan, promote, or operate a gun show," without verifying the identity of any "gun show vendor," defined to include not only dealers who display large inventories of guns for sale, but also individual customers who might discuss selling a personally-owned gun while at a show. The promoter would be required to make "vendors" sign "a ledger with identifying information concerning the vendor," and maintain the ledger for BATFE review indefinitely. S. 22 would make it a crime for anyone who is not a dealer to sell any firearm without running the sale through the National Instant Check System (through a dealer), if "any part of a firearm transaction takes place at a gun show."
National Reporting of Firearm Sales--S.22 would also require dealers to report to BATFE any sale of a firearm that has any connection, however remote, to a gun show.
