Moynihan's rationale for not supporting impeachment of Clinton is here. The abridged version:

Thus the Framers clearly intended that a President should be removed only for offenses `against the United States.' It may also be concluded that the addition of the words `high Crimes and Misdemeanors' was intended to extend the impeachment power of Congress so as to reach `great and dangerous offences,' in Mason's phrase.

The question now before the Senate is whether the acts that form the basis for the Articles of Impeachment against President Clinton rise to the level of `high Crimes and Misdemeanors.' Which is to say, `great and dangerous offences' against the United States.

Over the course of 1998, as we proceeded through various revelations, thence to Impeachment and so on to this trial at the outset of 1999, I found myself asking whether the assorted charges, even if proven, would rise to the standard of `great and dangerous offences' against the United States.

More than one commentator observed that we were dealing with `low crimes.' Matters that can be tried in criminal courts after the President's term expires. ...

Senators, do not take the imprudent risk that removing William Jefferson Clinton for low crimes will not in the end jeopardize the Constitution itself. Censure him by all means. He will be gone in less than two years. But do not let his misdeeds put in jeopardy the Constitution we are sworn to uphold and defend.

I did, and actually voted for him once. And I respected him when I saw him on Meet the Press, when he said that if Clinton lied before a grand jury it would “certainly be an impeachable offense.”

Months later, I saw him conclude on television that it was beyond a doubt that Clinton had lied to the grand jury, but he would not vote to convict him.

It was then I realized that I had been had for the last time by a hypocritcal lying Democratic party hack.

I read that he had a burst appendix last weekend,and he was okay for a day or so until serious infection set in that they could not control. He was my mother's all time favorite Senator,and I still get a chuckle thinking about his meanderings and prose on meet the depressed on Sundays. He always sounded like he had knocked down a few cocktails beforehand. He always had that twinkle in his eye when he would cajole a fellow Senator. I miss him already.

Sad to hear that he finally succumbed to the life after. My thoughts & prayers are with him, his family & friends.

Moynihan was a decent and honorable man, a true gentleman in an age in which they are few and far between. While I concurred with few of his positions, I am certain he took all of them after proper deliberation and because he truly believed they were in the best interest of the United States of America. May God bless his soul.

Yeah right like when he warned about kids having babies at 14 etc etc and then proceeded to VOTE FOR every damn welfare and socialistic bill that came down the pike.

Moynahan wasn't bad for an old Democrat, except he's partly the reason Hillary is now a New York Senator. She took his seat.

Know what I find very interesting? There is at least 10 times more eulogizing going on here than over on DU. The few over there who are commenting on him are keeping it positive and respectful, but there is just a strange lack of interest over there it seems. God speed, Senator.

I wasn't making any case for or against Moynihan. People had mentioned his vote on impeachment; I thought it might be enlightening and useful to see why he said he voted the way he did. Personally, I disagree with his conclusion.
