Here' the web announcement of where the anteewarr folk'll be training, from tonight through the rest of the week. Berkeley/Frisco are "rent-a-mob" communities, but this looks like more coordination than usual. These people could make it rough going for folks who work downtown.

Oakland, California: Nonviolent Direct Action for People of Color Tuesday, March 11th 2003 6-10pm Prepare yourself to take direct action to stop the war by attending a nonviolent direct action training.

Oakland, California: Nonviolent Direct Action Tuesday, March 18th 2003 6-10p Prepare yourself for Nonviolent Direct Action

Berkeley, California: Nonviolent Direct Action Saturday, March 22nd 2003 1-5pm Prepare yourself to take direct action to stop the war by attending a nonviolent direct action training.

Berkeley, California: Jail Solidarity Sunday, March 23rd 2003 1-5pm This training involves an in-depth explanation of strategies and practices of Legal Solidarity. Interactive role- plays let participants experience using non-cooperation tactics to bargain for fair treatment. We analyze decision-making in Solidarity and how to adjust tactics to be most effective in a given scenario. We focus on Court Solidarity as well as Jail Solidarity, stressing the different strengths and weaknesses of these strategies and how (and when) to transition from Jail to Court. Time: 4-5 hours

People of Color? what is that? I have black slave ancestry, Rufus Hargrove, but I am more colorful than he was. I have pale skin, freckles, and bright orange hair.
He was a good guy!

TRAITORS AND TURNCOATS: THE LAW OF TREASON - By Jennifer J. Hagan, Esq.
It has been said that treason is the "highest of all crimes in the United States. It must be so in every civilized state; not only because the first duty of a state is self-preservation, but because this crime naturally leads to and involves others, destructive of the safety of individuals and of the peace of society. This crime is defined by the Constitution itself and its magnitude may be inferred from the fact that it is the only offense defined in that instrument."

The Constitution, ratified by two-thirds approval in 1788, does not prescribe the punishment for treason but confers that power on Congress. In response, Congress has passed a statute regarding treason at 18 U.S.C. 2381. This statute reads:

Whoever owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States,
In interpreting the Constitution and the treason statute, the Courts have determined the following general rules:

a. Treason may be committed by an American citizen in any geographical location in the world and it does not require the traitor to be a resident of the United States.

b. American citizens, whether born citizens or naturalized, owe an allegiance to the United States wherever they reside.

c. Every species of aid and comfort which, if given to a foreign enemy, constitutes treason.

d. Any intentional act furthering hostile designs of enemies of the United States gives "aid and comfort" and constitutes "adhering" to such enemies is treason.

e. Treason comprehends an "adherence" to the enemy by one residing in enemy territory or country.

e. War can only be levied by the employment of actual force.

f. If war is actually levied, then all citizens who perform any part, however minute or however remote from the scene of actual warfare, and who are in league in the general conspiracy are traitors.

42 USC 1711 - not directly germane, but it's the best I could find on short notice:

(c) The term ''hostile force or person'' means any nation, any subject of a foreign nation, or any other person serving a foreign nation

(1) engaged in a war against the United States or any of its allies,

(2) engaged in armed conflict, whether or not war has been declared, against the United States or any of its allies, or

(3) engaged in a war or armed conflict between military forces of any origin in any country in which a person covered by this chapter is serving.

I believe that we should also be organzied and prepared - unlike most of the folks that attend these 'trainings'. most of us work. But we should be prepared to demand that we can carry on our daily business as usual.
I would like to hear what others have to say. This is not the '60's - we do not have to sit by quietly while the 'prostate and ponytail' club try to revive their youth at our expense

Here's a link to Cramer v. United States, where "[p]rosecution resulted from his association with two of the German saboteurs who in June 1942 landed on our shores from enemy submarines to disrupt industry in the United States..."

From the opinion:

Before the attack upon Pearl Harbor, Cramer openly opposed participation by this country in the war against Germany. He refused to work on war materials. He expressed concern about being drafted into our army and 'misused' for purposes of 'world conquest.'

Sound familiar?

Another snippet:

These materials indicate that the function of the overt act was to make certain that before a conviction for the high crime of treason may be had more than a treasonable design must be established; it must be shown that action pursuant to that design has been taken. The treason of adherence was defined essentially in terms of conduct for it involved giving aid and comfort. Yet the attempt alone was sufficient; the aid and comfort need not have been received by the enemy. Conduct amounting to aid and comfort might be innocent by itself-such as collecting information or stepping into a boat. It was sufficient if in its setting it reflected a treasonable project. It need not entail material aid; comfort or encouragement was sufficient. The only requirement was that it definitely translate treasonable thought into action which plainly tended to give aid and comfort to the enemy.

We don't have this sort of wishy-washy situation where an action might not be treasonous on its face, when they are conveniently stating openly that their intent is to disrupt the US economy by their actions, just like the intent of the German spies in Ex parte Quirin.

Remember, you have the authority under California law to effect a citizens' arrest and deliver the offender to the custody of the police. Be sure to get the names and contact info for the two witnesses for the treason prosecution.

I'm feeling generous today so I'm going to tell these clowns what "Direct Actions" they can take to stop the war. Really they only need to do 4 things:
1 - go to Iraq
2 - destroy Saddam Hussein's NBC weapons (I prefer the classic label to the wussy sound WMD)
3 - destroy Saddam Hussein's ability to make more NBC weapons
4 - Hang Saddam and his psycho sons from the nearest light pole

I garauntee that if you take these actions you will be 100% effective is stopping the war.
