I am more frosted at the Democrats for what they're doing to the Constitution vis-à-vis Miguel Estrada's than I am over the anti-war movement. Fox News reported that the GOP planned to call for a cloture vote on Estrada next week knowing they'd lose it. That would effectively amend the Constitution - illegally - to read that you need 60 votes instead of 51 to get a judicial nomination through.
Happily, it turns out the GOP isn't going to call such a vote. The offices of Senators Santorum and Hatch rang up my office on Friday, and said that the Fox story is not accurate. There will be no cloture vote. Hooray! If these Democrats want to filibuster the first Hispanic nominee to the D.C. Circuit Court, let them do it! I know they say there are new rules making a filibuster harder, but so what? And don't tell me that it's not "practical" anymore, because people have to go to the bathroom. That's nothing new.
Force them to get out there and filibuster this eminently qualified man, as rated unanimously by the American Bar Association. Miguel Estrada is just a name to us, but his life is being destroyed here. It's not because he's unqualified; it's because Democrats don't like how he might think. Read George Will's column. Chuck Schumer didn't bother to ask Estrada a single question. He claims not to know any less qualified judge, when in fact he knows less qualified judges who went to the Supreme Court! Just this week, President Bush pledged to stand by Estrada until he was sworn in. We know no other nominee has been asked to give nor should give opinions on issues that may come before the court. Their job is to apply the law, not to make law or let their opinions get in the way of rulings.
These senators have to back Bush and Estrada up. The Democrat attitude is, "We ran Washington for 40 years up until 1994, and Bush is illegitimate despite what the Constitution says about the Electoral College, so he has no right to appoint anyone." These people are treating the Constitution like toilet paper. Calling a cloture vote would overturn more than two centuries of Senate precedent and rewrite the constitutional definition of "advise and consent." We cannot allow that to happen. You have to care about this, folks!
These people aren't Democrats or liberals. They don't believe in the Constitution. They don't believe in individual rights, as affirmed in the 9th Amendment; in sharing power with the states, as described in the 10th Amendment; in free political speech protected in the 1st Amendment and shredded in campaign finance reform. They don't support the right to bear arms provided for in the 2nd Amendment. They don't respect private property rights protected by the 5th Amendment! If there's a blade of grass in the backyard, they call it "wetlands" and take it away! This assault must stop.

I went to the website and it was there in big bold letters at the time of the story "By Major Garrett" and I started griping about Garrett at that time to a Freeper! I was fit to be tied because the story was wrong!
Guarantee you if it had been Major Garrett contributed to the story, I wouldn't have been so mad.

What happened was I was looking for a story on the Net about the Estrada nomination and went to the Fox site looking for any story I could find. I saw there was a story about Estrada and clicked on it. At the time I saw it Garrett's name was right at the top.
Then when the article was posted on here I noticed it said contributed to by Garrett but I didn't go back and check the website. I noticed now that Garrett's name is at the bottom.
If it had been at the bottom when I saw it last night, I wouldn't have gotten so mad because I would have figured someone else was helping write it.
Either way, Fox wrote a wrong story!

Why are you being so...so...so Dem-like about this thread? Why are you lambasting TLBSHOW for posting it? It seems pretty evident to me that Rush originally believed Garrett's report on FNC and probably got upset about it just like most of US did. I was here as a participant on the live thread the other night --- until 2AM or so --- and it DID seem like the GOP was caving. It was confusing to me and apparently to other Freepers as well. It must've seemed that way to Garrett and maybe he wasn't thorough in his reporting. Today Rush heard from Hatch and Frist who said the Fox report was wrong and he is relieved. What's the problem with that? Why would you say something like "need more schooling?" We should stick together rather than divide!

I was here until 2 a.m. and after and the Republicans were not caving -- Sen Frist, Graham, and Sessions proved that after most people had left. We tried to explain to everyone what was going on that best could be described as psychological warfare by the Republicans. A lot of defeatist on that thread didn't understand what was going on and wouldn't listen. Those of us who stayed until the end figured out what was going on.
Garrett is supposed to know all about the Congress and not make a mistake of saying this was an historic event and that the Republicans lost Wednesday night. It was obvious from his article that he did not observe what was going on.
Read the first part of Garrett's story -- he was dead wrong -- it was not an historic cloture vote as he stated.

I believe they will go 24/7 only when Senator Frist determines it is the right time and only way to get the nomination through. That is true, although unfortunate in my opinion. I would much rather see the Republican leadership take off the gloves and make the Rats look like the fools that they truly are. Remember, they are doing something totally unprecedented in the history of our nation. They're acutally filibustering the nomination of a circuit court appointee, and a qualified one at that. The GOP leadership never did this when Clinton appointed judges to the federal bench, and that was when the Republicans actually controlled the Senate! Do the Democrats truly believe in their heart of hearts that we wanted Ruth Bader-Ginsberg to be on the Supreme Court?? Or are they just the frauds they've proven themselves to be?

The fox story last night was from an exclusive interview with Bill Frist if I read it right. And the quote from Frist in that story says that he is determined to get Estrada confirmed whether it takes days, weeks or months.
