I am more frosted at the Democrats for what they're doing to the Constitution vis-à-vis Miguel Estrada's than I am over the anti-war movement. Fox News reported that the GOP planned to call for a cloture vote on Estrada next week knowing they'd lose it. That would effectively amend the Constitution - illegally - to read that you need 60 votes instead of 51 to get a judicial nomination through.
Happily, it turns out the GOP isn't going to call such a vote. The offices of Senators Santorum and Hatch rang up my office on Friday, and said that the Fox story is not accurate. There will be no cloture vote. Hooray! If these Democrats want to filibuster the first Hispanic nominee to the D.C. Circuit Court, let them do it! I know they say there are new rules making a filibuster harder, but so what? And don't tell me that it's not "practical" anymore, because people have to go to the bathroom. That's nothing new.
Force them to get out there and filibuster this eminently qualified man, as rated unanimously by the American Bar Association. Miguel Estrada is just a name to us, but his life is being destroyed here. It's not because he's unqualified; it's because Democrats don't like how he might think. Read George Will's column. Chuck Schumer didn't bother to ask Estrada a single question. He claims not to know any less qualified judge, when in fact he knows less qualified judges who went to the Supreme Court! Just this week, President Bush pledged to stand by Estrada until he was sworn in. We know no other nominee has been asked to give nor should give opinions on issues that may come before the court. Their job is to apply the law, not to make law or let their opinions get in the way of rulings.
These senators have to back Bush and Estrada up. The Democrat attitude is, "We ran Washington for 40 years up until 1994, and Bush is illegitimate despite what the Constitution says about the Electoral College, so he has no right to appoint anyone." These people are treating the Constitution like toilet paper. Calling a cloture vote would overturn more than two centuries of Senate precedent and rewrite the constitutional definition of "advise and consent." We cannot allow that to happen. You have to care about this, folks!
These people aren't Democrats or liberals. They don't believe in the Constitution. They don't believe in individual rights, as affirmed in the 9th Amendment; in sharing power with the states, as described in the 10th Amendment; in free political speech protected in the 1st Amendment and shredded in campaign finance reform. They don't support the right to bear arms provided for in the 2nd Amendment. They don't respect private property rights protected by the 5th Amendment! If there's a blade of grass in the backyard, they call it "wetlands" and take it away! This assault must stop.

I'm going to give Garrett the benefit of the doubt That's my take on it too. Maybe Garrett had a bad day yesterday. I'd just as soon wait until I see a pattern before I accuse him of lying.

How about the rest of the paragraphs they took out? Fox News didn't even have the integrity to say that the original article was wrong. If you read the article from last night you are left with the wrong impression.
Fox News should have corrected it and said why it was corrected instead of making it seem like a new article.
If I were Sen Frist and the rest, I would never talk to Garrett again!

Senators Bill Frist and Orrin Hatch and whoever else in the Republican side of the Senate wants to do it, simply needs to go over to the House of Representatives and meet with Speaker Denny Hastert and Majority Leader Tom DeLay. At the meeting, you tell them this: Senate Democratic Leader Tom Daschle's wife Linda is a lobbyist. Since he's in the Senate, she cannot lobby at that end of the Capitol. She can only lobby the House. Do you see where this is going? You tell the House guys to send out a message:
"From this day forward, until the Democrats end this filibuster and start paying attention to the guts of the Constitution, any business brought before the House of Representatives by Linda Daschle on behalf of her clients is dead on arrival. None of Mrs. Daschle's clients gets one ounce of consideration before the House while this is going on." If you want to play the way the Democrats are playing, that's what you do. Heck, you could also hold the vote until these Democrats are on the campaign trail! This is not a game. These people must be stopped from destroying the Constitution.

I know. I remember seeing you on the live thread. I left when Lindsey Graham was giving a speech (a great one!) and missed out on what followed. At the time I left FR and turned off C-SPAN2, it looked like the Republicans were going to call it quits. People were saying how tired the Pubbies looked and the Senators evidently were saying how they needed to get back to other Senate business.
I understood from the next day's thread that Frist was going to call for a vote on Monday, then I saw Major Garrett's report which said a vote was going to be called for on Tuesday. I listened to Rush's show today and was happy to learn that MG's report was incorrect, according to Senators Frist and Hatch via Rush. I didn't come back to an Estrada thread until this one and was just surprised to see quite a few people picking on the individual who posted the Rush article. I just don't understand why there's an apparent animosity toward that person.

That's a great idea!
What I like is that Rush didn't hestitate to say he was wrong!
Cannot say the same for the Fox website! I am still waiting to hear back about my complaints to Fox that Wednesday night's vote was not an historic vote and it was not a bad night for Republicans.

This thread being posted doesn't bother me because it came from Rush's site. In fact, I went and checked to make sure.
Actually it has turned out to be a good thing IMO because it allows things to get aired out and cleared up.

Because what was put in ( ) by that one poster was misleading... Is that really such a big deal? I was able to determine that the headline was a little confusing, but the article explained all that needed explaining. If it's that important, ask an Admin to change the headline of the thread.

The GOP leadership never did this when Clinton appointed judges to the federal bench, and that was when the Republicans actually controlled the Senate! Do the Democrats truly believe in their heart of hearts that we wanted Ruth Bader-Ginsberg to be on the Supreme Court??
You raise a very good point. While I believe Orrin Hatch has been outstanding thus far vis a vis the Estrada nomination, he has made comments about how fair he was to the dems in confirming so many of Clinton's judges, because he stopped some of his fellow Republicans from fighting ones they vehemently opposed. All I could think of was how often the rats rolled him and thereby got some TRULY activist judges confirmed to the federal bench, and how Hatch shouldn't be bragging about it, because his own decency, sense of fairness and perceived WEAKNESS was used against him. The Senator from Utah no doubt expected "fairness" for a Republican President from his "good friends" on the other side of the aisle.
