Bush nominates jurists Democrats rejected for appeals court

WASHINGTON - President Bush renominated Texas Supreme Court Justice Priscilla Owen and Mississippi Judge Charles Pickering on Tuesday for seats on the 5th U.S. Circuit Court of Appeals, rekindling a dispute with Senate Democrats, who rejected the nominees last year.

Justice Owen and Judge Pickering were among 31 judicial candidates submitted on the first day of the new Congress.

While Justice Owen's defenders had vowed her name would be swiftly re-offered, Judge Pickering's future had appeared less certain.

Some had speculated that the White House would shy away from the Mississippi judge, accused by civil rights groups of being racially insensitive, so soon after the controversy over Mississippi Sen. Trent Lott's remarks on segregation. Sen. Lott, Judge Pickering's friend, recently ceded his Senate leadership post amid the furor over his comments.

Senate Democrats pledged to do whatever they could to keep Judge Pickering off the 5th Circuit, which covers Texas, Louisiana and Mississippi.

"Unfortunately, they have not learned from the Trent Lott episodes, and I am going to do everything I can to stop the Pickering nomination from going forward," said Sen. Charles Schumer, D-N.Y.

Supporters of Justice Owen, whose nomination foundered on charges she was a judicial activist with an anti-consumer, anti-abortion record, predicted she'd have a different fate now that Republicans control the Senate.

"I am confident that this outstanding jurist will be approved overwhelmingly," said Texas Sen. John Cornyn, who will help his one-time Supreme Court colleague from his new seat on the Judiciary Committee.

Sen. Kay Bailey Hutchison, R-Texas, also welcomed the president's action. "Her qualifications are indisputable," Ms. Hutchison said.

The Alliance for Justice, a liberal advocacy group that led the charge against the Owen and Pickering nominations, expressed dismay at the president's action.

"It is hard to believe that the administration wishes to re-fight the Pickering and Owen battles, which will revive such problematic issues for the administration as civil rights and corporate cronyism," group president Nan Aron said.

The Alliance for Justice, a liberal advocacy group that led the charge against the Owen and Pickering nominations, expressed dismay at the president's action.

Someone write the date down. The Dallas Mourning News used the word Liberal and it's NOT a consumer product ad !

A pessimistic thought though is that the Republicans on the Judicial committe will find a way to screw this up.

Sure sounds like a threat to me. I suppose "whatever" also means legal or not, ethical or not, truthful or not. In otherwords, typical democrat policy.

This will be a fun one to watch. Schumer's choice of words is interesting. Lumping Trent in with this, playing the race card, confirming that the Dems believe they need to teach the republicans a lesson on race and how to treat minorities.

This is great actually. I believe that as the dems continue to play the race card, while dealing from the bottom of the deck, more and more people will come to realize that the democratic party is void of ideas and void of ethics.

I guess I owe President Bush an apology. I didn't think he would have the cajones to do this. I was wrong, and I applaud him for taking off the gloves. Obviously, the current occupant of the White House is quite different from his father.

I have lived in both New York City and Mississippi. Race relations were much better in Mississippi.

The liberals are simply incapable of passing up more idiotic race-baiting when given an opening.

Bush will continue with calm, rational, plodding progress on important matters while the shrieking Dems raise hell over total nonsense.

This should serve as a bump to all those that have been saying President Bush doesn't have the stomach to go right at the Dems - he gave them the chance to act in a non-partisan manner for the good of the country and they spit on him. He quietly and discreetly wiped it off and is now going to feed it to them one slimy drop at a time.

It seems the Bush strategerists have decided to induce the Dems into burning all their fuel early. There was some question as to whether they'd put controversial nominees up front or wait until later.

If the Dems orchestrate a filibuster now, will they be as able to pull one off later on the Supreme Court nominees? They will be easily painted as hysterical obstructionists.

Particularly if they lose this one, they are going to have an even harder time keeping centrist Dems from approving more moderate nominees than Pickering.

Furthermore this keeps the Dems on racial topics, which they think is a winning issue, but only if it's a freebie for them. They are going to be wasting energy and capital on an issue which they largely own, as far as black voters are concerned.

Will the Dems have the cojones to orchestrate judicial filibusters while war is afoot?

America should concentrate on America. In America we have war based on race, income, etc. In America we have individuals with so much money, they don't have a clue what to do with it. Why can't we build houses for the homeless, ensure that every American has health insurance and the elderly don't have to chose between meds & food. Let's just clean up America before we dictate to the rest of the world.
