This just in from Antone family attorney, Johnny Cochrane:

Thaddeus, a potential Nobelist in Physics, simply panicked. He rushed up the vehicle to axe for a ride. He was running late for Bible Study Class, because a Physics Lab experiment took longer to complete than his teacher had realized. He also had to drop his Choir Robe at the dry cleaner and pick up his 'cello for the Eagle Scout Orchestra Concert. The pressure was intense.

Cochrane has gotten testimony from Dr. Henry Lee which proves that the Marine Sgt. was injured when his own weapon went off. Thaddeus was just reaching for the small black Bible he had always carried, to comfort the poor fellow, when this unfortunate misunderstanding took place. On behalf of the bereaved family, Cochrane is suing McDonalds, The Marines, The Vehicle Manufacturer, The Weapon Manufacturer, The Ammunition Manufacturer, the County, The Town, The Hospital which was unable to revive young Thaddeus, and Jim Robinson and the Freepers.

An angry Cochrane told reports:

"When my clients takes a hit, no end of folks must remit."

Bama ccw laws allows you to have a loaded weapon in the vehicle. Even before I had a ccw permit I'd carry the weapon in the vehicle. When stopped by a police officer, all you have to do is let the officer know you have a weapon in the vehicle and they'll not harass or bother you. Well other than give you a speeding ticket! Just tell them you've got a weapon so they won't be surprised and no problem!

you're right in the principle you put forward, but your facts are a bit off. it didn't happen in a school. a school event, yes, but off-campus. how do i know this? spent some time in that bar, lived in that town, some years back. more poignantly, I knew the teacher who was killed.

This panhandling at a drive up box has become common in some places in the South. My son and I, pulled up to a Burger King in New Orleans to place an order, there was a large bush behind the order box and out steps a man right in my face asking for change.

In this instance the panhandler decided to kill. As things worsen panhandling at the order box will spread and so will car jackings at the order box. Yet another thing to have to guard against.

This happened at the McDonalds right outside the gate here at Maxwell AFB, AL. You don't want to be outside the fence after dark. Good on this guy for defending himself.

The perp's dad still says his innocent lil son would never have done this. More to come on this story.

Here is another local news article. Notice that the poor "victim's" (i.e. the dead thug),father say that he son already has a car and he has doubts about the police investigation.

Sgt. James Lowery was shot in the face before he gunned down his alleged attacker
A Marine passing through Montgomery was improving Wednesday after he was shot by a man trying to steal his SUV, police said.

The Marine returned fire with his own gun, killing the robbery suspect.

"At this point, all indications are they (charges) are not likely," said Lt. Huey Thornton, a Montgomery police spokesman.

The incident began about 9:40 p.m. Tuesday when Sgt. James Lowery, 22, pulled into the drive-through lane at McDonald's, 3450 Day St.

Police said Thaddeus Antone, 19, of 1156 Perry Hill Road, walked up to Lowery's customized Chevrolet Suburban, drew a handgun and demanded the vehicle.

When Lowery, whose hometown is listed as Havelock, N.C., began to get out of the Suburban, Antone fired, striking the Marine in the face, Thornton said.

Still conscious, Lowery reached into his vehicle, pulled out a handgun and fired multiple rounds, at least one of which struck Antone in the back, and killed him.

Antone was pronounced dead at the scene while Lowery was taken by ambulance to Baptist Medical Center South, Thornton said.

Mandy Harrison, a Baptist Health spokeswoman, said Lowery was in fair condition late Wednesday. She said Lowery was having difficulty speaking and that the Marine's wife declined to be interviewed.

In addition, a woman who answered a call to Lowery's room said the family did not wish to comment.

The shooting incident left a father grieving for his son.

James Antone admitted his son recently was arrested and charged with marijuana possession and carrying a pistol without a license, but the father doubted the actions attributed to his son.

"I have a lot of doubts about this investigation as far as the Police Department is concerned," he said.

James Antone said his son already had a car that police found nearby on Keystone Street, and said he believes a blue Chevrolet Blazer that sped from the shooting scene may have been involved.

Police originally thought the Blazer was involved, but now officers say the driver of that vehicle just wanted to flee the danger when the two men exchanged gunfire.

"Everything is kind of hard to explain. I just have a lot of doubts," Antone said.

Little is known about the Marine.

Lynis Cox, a Maxwell-Gunter Air Force Base spokeswoman, said Lowery had been staying in temporary lodging on the base.

The violent incident, which police termed an attempted carjacking, isn't the first such crime that turned fatal this year in the Capital City.

On Feb. 15, Marilyn Hicks, 81, was climbing out of her car at Vieux Carre Apartments on McGehee Road when a man threw her to the ground and began kicking her.

Hicks died from complications related to her pacemaker, and the case became a murder investigation that was capped in October, when police charged William Julius Summerville, 21, of 3714 Audubon Drive, with capital murder.

The suspect in the beating death fled in Hicks' car.

Assistant principal Joel Myrick ran to his car to get a .45, so he could detain school shooter Luke Woodham, who by then had left the school where the shootings took place, and was headnig to a junior high (with a deer rifle and something like 36 rounds of live ammo). Myrick stopped the perp's vehicle near a wooded area and detained the shooter for police, who knew Myrick. There was public outcry for Myrick having had the gun in his car on school property, but the state law held that a vehicle was an extension of one's domicile, making legal the loaded gun within. (However, technically, they could have charged him for taking the gun out of the car, but they wisely declined.)

A group did a study of the coverage of the event, and of some 400 stories of the shooting, about 4 of the articles mentioned that Myrick got a gun from his car to detain the shooter. The other 396 didn't mention this uncomfortable truth to their audience.

I love the way this reporter i strying to equivicate a victim killing his attacker with an attacker killing his victim. Frame this nonsense with the statement that carjackings are more frequently becoming fatal.

I retired from Maxwell in August 2001; you are correct, you DON'T want to spend any time in the neighborhoods around the base at night. BTW, this is the second time in less than two years that a military member has been targeted at a fast food drive-through window. Just before I retired (and moved back to MS), a young airman on leave from a base in Texas was shot and killed by an assailant. That attack (as I recall) took place at a fast food joint just off I-85.

Semper Fi, Sgt Lowery, and here's hoping he has a speedy recovery....
