Yes, but it's still too early to tell if that is good news or bad news.

Did they turn it down because they knew it would look bad, or did they turn it down because some political "untouchable" (e.g. Lisa Beamer, though I don't mean to slander her) is going to get the nod?

The other thing about this is whether the Democrats will drag the media into the slime with them. How will the media cover this? Will they cheer the Democrats on or question the tactics? Will they focus on the loopholes and make it sound legal or will they focus on the voters and question the shenanigans?

The United States Code mandates that the federal general elections be held on the Tuesday after the first Monday in November. 2 USC §1, 7. The United States Constitution proscribes six-year terms of office and the placement of seats in specific classes mandating the end of their terms. US Const. Art I §3(1) & (2).

The United States Supreme Court has interpreted the Times, Place and Manner clause as mandating the November general election and held that any conflicting state stautes are inoperative so far as the conflict extends. Foster v. Love, 532 US 67, 118 SC 464, 139 LE2d 369 (1997).

McGreevey cannot appoint anyone for a 6-year-and-three-month term. The election must take place as scheduled on November 5. End of story.

Most likely, because they'd be giving up their sure chances of election to the House for a toss-of-the-dice chance at the Senate.

Nobody in their right mind would do that. It'd have to be somebody who's not currently in office.

I mean . . it's like ya run your election and if you're down in the polls by 14 (as torch is) you just ask the party to pull you and do it all again in a few months.
