Gawd, what an a$$! Or he might be wreaking his revenge on the people who are forcing him out. He's not resigning, and he's filed a case that's probably a loser with the NJ Supremes. He may be engineering his defeat in November.

Can anyone tell me why the Torch (for the sake of the party he holds so near and dear) didn't resign and avoid the legal maneuvering that will ensue? Had he done so, I believe McGreesy would have appointed someone to replace him and wait a full year before holding a special election (or at least that's how I interpreted Judge Napolitano's reading of the law).

We have to sweat the next 36 days until election day.....at any time in those 36 days the TORCH could resign and McGreevey appoint another DEM to fill the seat ....then the election is pushed back til 2003...
And I think the RATS would risk the HEAT to save the Senate.

Here's another argument: The NJ legislature was very serious about having a bright line deadline. We know this because the last time the legislature considered the issue, rather than the deadline being softened or shortened, it was actually EXTENDED from 34 days to 51. We cannot now presume that legislative intent gives us enough latitude to permit a change at 33 days...

Except that that was a primary election, not the general election. The Senate rules said that the winning candidate of the general election had to be a resident of the state, and the dead aren't residents. Carnahan should have been disqualified, unless the courts wanted to extrapolate from one ruling to another. I can see creating a vacancy with intent for the primary, but not the real thing. Voters would be giving up their constitutional right to elect Senators if they intentionally created a vacancy to be filled by the governor.

Are you saying that the courts will make an exception for death, not for scandal?? If the courts overturn state law, and make this exception, then it will establish a precedent that will allow any candidate, in any senatorial election to pull this stunt.
Hell, Bill Simon could pull it in California, right now.
