IRS Targets Offshore Accounts

WASHINGTON – The Department of Justice asked a federal court in Miami on Thursday to let the Internal Revenue Service serve a "John Doe" summons on MasterCard International.

A "John Doe" summons would enable the IRS to obtain information about people whose identities are not known, the department said.

The information obtained in the summons would help in identifying people who use offshore accounts to evade their U.S. tax liabilities, according to the department.

In October 2000, a federal judge in Miami approved a similar "John Doe" summons on MasterCard International for 1998 and 1999. That summons targeted the records of cards issued by banks in the Bahamas, Antigua and Barbuda, as well as the Cayman Islands.

The petition filed Thursday seeks records for 1999, 2000 and 2001 of cards issued by banks in more than 30 countries.

The countries include Liechtenstein, Switzerland and nations bordering on, or in the Caribbean, such as Belize, Bermuda and St. Kitts and Nevis.

Recently, a federal court in San Francisco authorized the IRS to serve a summons on Visa International for records of cards issued by banks in those same 30 countries.

The department's Thursday filing says that in response to the earlier "John Doe" summons, MasterCard International produced records that led to civil audits and criminal investigations of many U.S. taxpayers.

Those taxpayers include people who have used offshore credit cards to pay for expenses such as jewelry, hotel and car rentals, airline tickets, restaurants, cell-phone and online services, department store purchases and groceries, the Justice Department said.

Dear Federal Government,

PLEASE PROSECUTE ME.

I, Larken Rose, have not filed a federal income tax return for 1997 or any subsequent year.  This is not because I am protesting any law, or because I do not want to pay my “fair share”; it is because I refuse to be a victim of the biggest financial fraud in history.  I also refuse to remain silent while government lawyers illegally defraud my fellow Americans. 

People by the thousands are learning that the “conventional wisdom” about the federal income tax is just plain wrong.  As more and more Americans are discovering that the law itself shows that the income of most Americans is not taxable, DOJ and IRS officials are desperately trying to distract from the issue by dishonestly portraying it as a frivolous “tax protestor” argument, and by trying to silence (via court injunctions) those who publicize the issue.  This summary shows why the IRS and the DOJ refuse to have an open, honest discussion about what the government’s own regulations say:

Point 1: The federal income tax applies only to one’s “taxable income,” not to all income, and the income tax regulations (e.g. 26 CFR §§ 1.861-1(a)(1), 1.861-8(a)(1), 1.863-1(c)) clearly show that one’s taxable domestic income is to be determined under the rules of 26 USC § 861(b) and the related regulations beginning at 26 CFR § 1.861-8.  (Other sections explain when income from outside of the U.S. is taxable.) 

Point 2: So why does it matter whether we use those sections to determine our taxable domestic income?  Because more than 80 years of statutory and regulatory history prove beyond any doubt that 26 USC § 861(b) and 26 CFR § 1.861-8 show income to be taxable only when it comes from certain types of international or foreign commerce.  In other words, contrary to what “everyone knows,” most Americans do not receive taxable income, and do not owe federal income taxes.

IRS employees across the country refuse to honestly address the issue, and instead resort to threats, evasions, and accusations, because their own law books expose the biggest financial fraud in history: the misrepresentation and misapplication of the federal income tax.  (See www.taxableincome.net for more information.)  The nationwide pattern of Gestapo-like tactics by the IRS and DOJ against those who speak the truth is shown in detail at www.Theft-By-Deception.com/declaration.html.

I will not stand by and allow myself, my family and my neighbors to be extorted simply because some power-happy bureaucrats huff and puff about all the nasty things they will do to anyone who does not “comply” with the IRS’ misapplication of the law.  To the DOJ and the IRS I say this: You know I am among the most vocal about this issue.  Stop terrorizing the American public, and come get me.  Make an “example” of me.  Surely if my position is “frivolous” and completely devoid of merit, then the DOJ attorneys can easily refute my position in front of a jury, and have me convicted and imprisoned.  (I’m not exactly hiding, am I?)  You already have what would be “Exhibit A” in my defense: my Theft By Deception video.  So take your best shot.

Just ask anyone in America if they realize how much stronger our nation would be without the IRS. Without the 22% that is essentially built into every single purchase we make due to regulatory costs being passed on to the consumer, our economy would explode.

Starting back in 1913 when Philander Knox (of Ft Knox fame) rubber-stamped the ratification of the income tax into law, we've been lied to ever since. Anyone in here that tries to defend the continued financial rape of each and every one of us by the IRS should re-examine their conservative credentials. If indeed our job in here is to inform each other as well as the rest of the public, then this is an issue that deserves further teaching.

I've got an easier way to deal with the IRS. Quit working! Seriously, just work as little as possible to pay the basic bills, and take the rest of your time off. That way you keep your income below the threshold where the IRS comes to rape you, and you don't have to deal with lawyers and lawsuits and panting IRS shills sending you nastygrams and filing leins on your property.

I've learned my lesson here in America. I only work JUST ENOUGH to pay for the basics, and that's it. I got tired of being raped by the government every single year so that loafers and freeloaders could sponge off of me.

The only way to win against the government is the same way to win against any other addiction, you can't win so you can only surrender. In this case surrendering means giving up on earning enough to get ahead, since the government just takes it away.

The really funny thing is that if you don't work at all, the government sends YOU money! Isn't that a kick in the head? Punish productivity, reward uselessness. That's the government way for you.

Another way to get ahead is to buy a house, fix it up, and sell it two years later. You can make up to $500k TAX FREE every two years. I was going to start a business, but when I figured out how the tax code is set up, well, no new businesses for me. I just buy a house, move in, fix it up, live in it for two years, sell it, and keep the profits from the sales. Sure, moving every two years is a hassle, but the tax free profits sure make up for it.

You see, the goverment HATES productive people. This is why I've learned to quit being productive, and instead I've learned how to "game the system". Uncle Sam takes %50 of everything I make if I work for money, but if I improve properties and then sell them I can keep all of my profits. Gee, what do you think I should do with my time? Pursue business opportunities so that the government can steal half of what I earn, or fix up houses and keep %100 of the profits? Boy, that's hard to figure out.

But that's OK, there's lots and lots of people in India and China who are willing to come over and do the work that gets taxed at the %50 rate. Let them pay the taxes, until they wise up.

You left out a whole bunch of stuff, like confiscate property, seize bank accounts, bringing criminal charges, put you in jail to name a few.

It is not worth the trouble you will get into challenging the King. And remember, Traficant is in jail so you can not look to him for help.

Yes, I did leave off a few things - I figured that all of us in here know the rotten tricks of coercion that the IRS uses. And even though I'm not the one challenging the IRS to find me as is the gentleman whose e-mail I posted above, I tend to agreee with him 100%. The IRS began its' life as -believe it or not - the collection arm of the Puerto Rican Alcohol Tobacco and Firearms enforcement. They are ONLY authorized any power in the Commonwealth states of the US and Washington DC. Figures.

No, I'm not working "within the system". I don't officially earn enough money to be required to file. No, I'll never get ahead in the stereotypical "American Dream" - BUT I'M FREE!!!!!

This isn't your klinton Justice Department any more.  This time, it's Dubya's boys, trying to further destroy the Constitution, so the federal government can RULE us the way they want.  Republicans cried foul as the klinton crowd chopped up the 4th Amendment into little pieces.  But, where are they now that Dubya's crowd is preparing to puree what's left of it?

Dubya signed Campaign Finance Reform and they made excuses.  Dubya signed the USA Patriot Act and they made excuses.  Dubya's Justice Department took aim at the 4th Amendment in their MasterCard case in San Francisco and they made excuses.  Now, Dubya is attacking the 4th Amendment again and I suppose that we will hear more excuses.  I suppose that they'll claim that it's all right for the government to claim probable cause for a search, based on what credit card a citizen holds.  Next, it will be what school your child goes to, what car you drive or if you own a gun.

I wonder what it's going to take to make Republican voters realize that Dubya isn't anywhere close to conservative.

Klinton's attacks on wealth and privacy caused a steady increase in expatriation of wealthy citizens, throughout the 90's.  But, as a result Dubya's even more aggressive attacks on privacy, aimed at the wealthy, we can expect to see a sharp increase in capital flight before Dubya leaves office.  Of course, since the wealthiest 1% of taxpayers pay over 36% of taxes collected and they are the ones who are being forced to leave, it means that we will be losing a disproportionately large amount of our tax base, forcing taxes up for those who remain.  So, thanks to Dubya's compassionate conservatism, those of us who remain will get to pay higher taxes.

Hey!  I think that I'm beginning to get the hang of this compassionate conservatism thing.  It's really all about tearing down the Constitution.

I gotta ask you about something else. Social Security will prove unfinaceable when the Boomers all retire. I think the politicians will start paying those benefits by debasing the dollar. What happens when the inflatation from that gets really bad?
