I am sorry but you seem to trust the government way too much. N one should be held without charge and without a voice or we are all set up for the camps (concentration, re-education or whatever name is current).

Yes it is outrageous there are 2000 people held indefinately with no rights and no contact with their families,being held on 'suspician' indefinately,even if 500 are terrorists process them or charge them,we've already seen 2 cases from the FBI where people were held who had nothing to do with anything.If you must make them wards of the state so at least they have an official status and certain rights,this is too similar to what the Gestapo,Kgb or Stasi would do.

A Clinton appointee. Claims to be a big women's rights activist. Speaking as a female and a lawyer, I'd rather have women on the bench who are *smart.* She's an embarassment in this town. You should hear the lawyers ridicule her. Her style is prissy and abrasive -- which only works if you know the law. She doesn't. Hence she's the butt of many jokes. So much for women's rights.

Please don't land on her too hard for being a woman. I'm one too, only smart and conservative. Her problem is that she's brainless, not that she's a girl. So we don't REALLY need to discuss no-so-well kept secrets like her anorexia here, do we? ;)

The fact is, these 147 detainees represent a miniscule percentage of the population, but likely represent a sufficient number to carry out terrorist attacks within our borders. Terrorism.

Yes, I do trust this government over the lying, conniving, non-caring administration it replaced.

Add to that the fact that civil liberties on a few have been suspended in other wars (Civil and WW2 most pointedly) and yet the Republic survived. Civil liberties were restored immediately after the hostilities ceased.

I am amazed so many are willing to paint our war effort in the worst possible light. We're at war, folks. You might not see the bombs bursting in air every day, but it is still a war. We have to fight to win.

DOJ is supposed to ask them!! LOL!!! Perhaps DOJ should serve them tea, too. There's more on all this and how she ruled on a ridiculous FOIA theory (she said Section 7 doesn't apply: this is a *textbook* case for Section 7 exemption). She fancies herself a big privacy expert, even though Judge Kessler was overruled in a fairly famous privacy case. Got a minute? Sit back and hear about this nitwit ruling:

She ruled that a Smithsonian employee, one Margaret Dong (a screw-up who was busy suing her employer for a bunch of stuff, which is ridiculous, Smithsonian is the best employer in town) was entitled to file a lawsuit against her employer for violation of privacy. The violation? Her employer, suspecting that Ms. Dong had without the Smithsonian's knowledge taken a Monet on a little trip to Europe with the MOMA museum of New York!! And the violation of privacy? The horrified Smithsonian officials *dared* to call the MOMA officials in NYC to see if this rumor was actually true. It was!! Although the Monet returned safe and sound, they of course disciplined Ms. Dong. She agreed she'd done wrong. But then she turned around sued the Smithsonian, saying it was a violation of priavcy not to check with *her* first rather than calling the MOMA museum officials to see if she had committed wrong.

Judge Kessler was reversed. But one really had to wonder what she was thinking. She wrote something emotional in her decision like "Now Smithsonian employees will never have to worry about their privacy being violated like this." I can't remember the words. But it was something pretty stupid.

She's been reversed with remarkable frequency for a new appointee. She's kinda a laughing stock in the bar. Lawyers of all political stripes are careful to water down their arguments before her: she thinks she's smart, but she's not following stuff well. Actually, due to her idiocy, she's not that dangerous an ideologue. You want someone who could do serious damage on the bench, I give you Judge Friedman: very left and very very smart, a crafty politico. Judge Kessler can't do much damage except keep the D.C. Circuit busy reversing her.

What is "outrageous" is that you don't see the dangerous precedent the govt is trying to get away with.

Citizens of the US are so in denial about the form our govt is taking. Years ago, when people talked about the US becoming a socialist police state, they were laughed at. Those in denial still laugh, but reality is closing in fast.

Can you spell "Quota"? Can you spell "Affirmative Action"?

No, I wouldn't land on her for being a woman, however you and I can certainly imagine just what kind of a woman she is if she was a Clinton appointee.

Roger that. But she didn't get on 'cause of some quota. There are plenty of talented leftist women -- no really, some are bright and hence could be more dangerous -- that Clinton could have put on the bench. She got on because she's a friend of Hilary's social circle -- a Women's Law Center lawyer. She's also friend with Lois Schiffer, who used to be General Counsel for National Public Radio. She got on because she lunched with the right feminists. That's not about quotas. It's about something much more dangerous.

Barbara Olson, God rest her soul, was right. It's sounds paranoid but it's true: Sen. Hilary Clinton was and is part of this little social group of feminazis. Judge Kessler's thick in the middle of that group.

The D.C. Circuit will reverse her in record time. As a technical matter of law, this decision is totally dead in the water. This is Section 7 FOIA caselaw, very well established and very well known to her appellate bosses. I think any panel on the DC Circuit will reverse -- even Clinton appointees. I assure you, as a legal matter, this decision is way way out there.
