First degree murder is ridiculous for this tragedy. It will never hold up.

First degree murder is ridiculous for this tragedy. It will never hold up. Yep. Her kids just slipped her mind. Damn I hate people that think like you.

Fox News report more details about this case .. one being that there were lip prints on the window and it is thought that the 3 yr old was trying to somehow get air to breathe

I don't care what she's charged with. I don't care what she's convicted of. This woman is terminally stupid. Put here away for a decade and let her sort things out!

And she is pregnant too
To: kattracks
She originally claimed to have been kidnapped and raped. When she was taken to the hospital for examination, it was discovered that she is also pregnant!

Give me a break. Let me guess, in your mind we should feel sorry for this poor woman since she's just lost her two children.
Forget the fact she originally lied to the police, saying she'd been abducted and raped. Forget that she believed getting her hair done for 3 hours was more important then her children. Forget that her kids were literally baked inside a car where the temperature reached well over 100 degrees. Poor thing, her kids are dead.

Never?
We don't know the facts.
What will you say if she took life insurance out on her kids a month ago...
The point is we don't know. Let's see what the full story is.

I think you are correct. The police, or more specifically, the prosecuting attorney's office, must have some evidence to this effect.

I agree... First degree murder will not hold up.
What she did was careless and negligent, and her behavior afterwards will not help her in sentencing, but it is not premeditated murder.

I think he is saying it will be easy for her to get off on a murder charge, because she didn't have intent. They should have charged her with negligence, manslaughter, and anything else they can get.

Terminally stupid, irresponsible, cruel, trash, selfish, yes. Murder one? Give me a break. Last time I checked one needs 'Intent' to kill.
I draw an analogy to drinking and driving laws where some bombed maniac kills a pedestrian. Regardless of their stupidity and loss of control (mental and physical), 'Intent to kill' is a massive jump from what it really is.
We shouldn't apply "Intent' so liberally, in my opinion.

The lip prints have me heartsick.

To clear things up:
The "muder one" charge is misleading here. She is *actually* charged with 1st degree child abuse, and felony murder as a result of the children's death. Felony murder is "murder one," if you want to call it that. Intent is not necessary for felony murder, ergo, intent is not necessary here to charge this woman.
In my personal opinion, they are using the felony murder charge in a way other than the legislature intended, but it is what it is. The shoe fits and they are wearing it.

The Detroit Free Press article says she's "charged with two counts of felony murder Sunday because Oakland County prosecutors say the children died while another felony -- first-degree child abuse -- was happening. Maynor could spend the rest of her life in prison if she is convicted."

Thanks for the clarification.

but it is not premeditated murder. It's not beyond the realm of possibilities. Recall Susan Smith's kids in the car rolling into the lake was made to look like an accident, too.
