SPONTANEOUS PLEDGE RALLY

1:15PM Today: Come join MELANIE MORGAN for a spontaneous recitation of the Pledge of Allegiance today outside the 9th Circuit Court at 7th St. & Mission in San Francisco! A special guest MYSTERY SPEAKER will also be on hand to speak to the crowd! BE THERE to show your disapproval of the Court's ruling that says the Pledge of Allegiance is unconstitutional.

I'm sure that I'm not alone when I state my displeasure with these pricks on the West Coast, if you don't like the way things are. Move your @ss to Afghanistan, China or maybe Iran. I've argued before the 9th Circuit Court. Considering that it's found in a magnificent marble building where every piece of furniture seems to have a little "historic" plate, it's sure located in a grimy part of town.

The Ninth Circuit also has its decisions overturned most frequently. Look for this ruling to be struck down on appeal.

If one can call Nixon that, yes. And made when the Senate (which had to confirm) was about 2/3 Democrat.

The judge is essentially retired, but due to the judicial crisis of vacancies being unfilled thanks to the obstructionist policies of Daschle and Leahy, all of George W. Bush's nominees for this circuit are languishing in confirmation purgatory.

By the way, the judge that voted against this silly ruling was appointed by George H.W. Bush.

If one were to look at the percentage of judges appointed by Democrats who turned out to be activist liberals without even a smidge of common sense, it would be nearly 100%. While it is annoying that the Republican percentage would be greater than zero, it still would be much, much less.

David Souter hid his liberalism well until he got his appointment. He was considered conservative until he got his lifetime seat.

Good point, however if the spot he holds was allowed to be filled by our current Pres. how secure are you in believing that a Bush nominee wouldn't have ruled the same way ?

So what? He was appointed over thirty years ago. Even many DC Supreme Court Judases, oops, Justices changed their stripes midstream over this past century, probably much to the dismay of their appointers.

This 80-year old judge who was hauled out of retirement has lived in the ultra-liberal San Francisco milleu for so long, no wonder his brain became addled. He was also probably resurrected because his anti-American handlers know he's of such an age that he doesn't give a crappola about the furor his decision has engendered. Nothing happens by accident in the big leagues.

I am secure in believing that the odds of a Bush nominee ruling the same way is significantly lower than the odds of any Democrat nominee.

Yeah, unfortunately sometimes Republicans throw in a clunker like (to repeat myself) a David Souter, or a Judge Alfred E. Newman T. Goodwin. But more times than not, we get a Thomas or a Rhenquist or a Scalia or a Kuhl. Meanwhile, all Democrat judges seem to be clones of Ruth Bader Ginsberg.

Alfred T. Goodwin, the judge who made the ruling is a senior judge, which means he is retired. I tried searching for information when he was asked to come out of retirement, but could not find one. Here's what I did find.

      District Courts with Fourteen Vacancies

      As of March 1, 2002, the United States Court of Appeals for the Ninth Circuit had four vacancies on the 28-judge court. For most of the past five years the court has had between five and ten vacancies that need to be filled by presidential nomination and Senate confirmation. The President has nominated individuals for two of the four positions.

      As of March 1, 2002, there were 14 unfilled vacancies on the district court bench. The vacancies exist in the following districts: Alaska (one), Arizona (one), the Central District of California (six), the Eastern District of California (one), the Northern District of California (one), Hawaii (one), Nevada (one), Oregon (one), and the Western District of Washington (one).
