Prosecutor recognized by gun-rights group

Thursday, June 6, 2002

By Steven Hepker
Staff Writer

Jackson County Prosecutor John McBain has been named prosecutor of the year by the Michigan Coalition for Responsible Gun Owners.

"He has done quite a few things to set him apart from other prosecutors, particularly his support of the new concealed-weapons law, the new handgun-transport law and his work on the Jackson County Gun Board," said Ross Dykman, executive director of the gun-rights group.

The group also named state Rep. Steve Vear, R-Hillsdale, and state Sen. Chris Dingell, D-Trenton, legislators of the year for pushing through the Vear Transportation Bill.

Enacted this spring, the law makes it legal to transport unloaded handguns in vehicles, even without a concealed handgun license. McBain spoke in favor of the bill before the state Legislature last winter.

McBain had joined the fight to amend the 1931 law after a Detroit-area man driving through Jackson County lost his pair of expensive, matched pistols on his way to a competitive shoot.

State police seized the guns and later destroyed them, even though the man was not charged with a crime.

"The new law relegates handguns to the same status as long guns," McBain said Wednesday. "Michigan was one of the most restrictive states in the nation."

Before, it was illegal to transport a pistol to a gun class or to be registered, which meant that many responsible gun owners had to skirt the law in an attempt to be legal, McBain said.

Under the law, transported handguns must be unloaded, in a case and in the trunk of a car or in a place not readily accessible, and the owner of the gun must be in the vehicle, McBain said. All handguns must be registered.

State Sen. Philip Hoffman and state Rep. Mickey Mortimer, both of Jackson County, also supported the bill.

McBain received the award Saturday at the Lansing Civic Center. Wayne LaPiere, director of the National Rifle Association, was the featured speaker.

Correction: State policeCriminals in the employ of the state seized the guns and later destroyed them, even though the man was not charged with a crime.

I wish people would start recognizing criminal government agents for what they are. The government agents in this case willfully deprived this person of his property without due process of law, in a manner clearly contrary to the Supreme Law of the Land. Since all legitimate government personnel (at state and subsidiary levels as well as federal) are bound by oath to support the U.S. Constitution, those people who are not are criminals impersonating legitimate government agents.

Dan, is McBain the one that built his garage in his neighbor's yard, or was that his predecessor?

And which jerk prosecuter charged all the kids skinnydipping in a backyard pool with "criminal sexual conduct," and then listed them on the MI pervert web page?

I no longer live in Jackson, but I used to - up in Essex Heights.

Probably the guy before him.

Was it before 98 or 2000? McBain took office either 98 or 2000. I'm not sure when. From what I've heard though, his predecessor was a real ass, and I think he primaried him out. All I know is that there was a big fight for election in his first term.

I am outraged that a person is not allowed a near at hand, loaded and ready to shoot weapon while traveling in a car! I often drive the highways for many miles by myself, and would feel very insecure without my "friend" easily available if the situation warranted it's use. To me, it's the same as having auto insurance--something you buy and hope to goodness you never need to use.

My wife says it was the guy we tossed out in '98, but neither of us can remember his name. Has jackson city hall fallen down yet?

Bwhahahh. Not sure. I once made a wrong turn going to an MCRGO meeting in downtown Jackson. "Caught up in the wrong side of town". That part looked like Pontiac. What a difference two blocks make.

I've heard McBain is running for judge now. There is the BIGTIME gun grabber Sheriff Z who is thinking about running for prosecutor. If I lived in Jackson County, I'd be voting dem there.

Mickey Mortimer is running for Phil Hoffman's spot in the state senate and is as good as it gets. Clark Brisbee is staying put at state rep in the city area seat and he's a gun grabber.

We need to do alot more of this -- all A2 groups.

Too often we take our people for granted while the press continues to pound at them. I think it goes a long way if we get on the phone and say, "Thanks, good job!" whenever someone makes the right decision or takes positive steps to defend the Bill of Rights.

If anyone knows John personally, pat him on the back and tell him thanks from everyone across the country who gives a damn about their right to defend their families.

Brisbee stuck one of campaign signs in our yard once (without asking), and my wife called him up and screamed at him. He came out and got it back about five minutes later.

We all can help him out. He's running for judge. Do you want this man to be a federal judge someday?

In Michigan, judges are elected, and that takes money as well as time. I can vouch for McBain personally. I don't know him well, but I have met him a few times, and know he's a friend of MCRGO in his actions as well as talk. That's why he's prosecutor of the year.

Here is his Committee Mail Address

COMMITTEE TO ELECT JOHN MCBAIN FOR CIRCUIT JUDGE
119 N BROWN
JACKSON, MI 49202
