Court declines to hear Beazley's appeal
Defense to petition court again Tuesday, when Texan is set to die

The U.S. Supreme Court declined Friday to review the appeal of Texas death-row inmate Napoleon Beazley, whose case has become a focus of national and international opposition to the capital punishment for youthful offenders.
Mr. Beazley was 17 when he fatally shot Tyler businessman John Luttig during a botched carjacking on April 19, 1994. He is scheduled to be executed Tuesday for Mr. Luttig's murder.
Attorneys for Mr. Beazley asked the U.S. Supreme Court this week to review his case to determine whether the execution of an offender who was under the age of 18 at the time of the offense violates constitutional prohibitions against cruel and unusual punishment.
Prosecutors say Mr. Beazley was an adult in the eyes of the law, committed a horrific crime and deserves the death penalty.
Beazley attorney Walter Long said that he planned to petition the Supreme Court again Tuesday.
The Texas Board of Pardons and Parole also could recommend to Gov. Rick Perry that Mr. Beazley's death sentence be commuted. Such recommendations are rarely made.
The board's chairman, Gerald Garrett, said the board members will be reviewing Mr. Beazley's case over the Memorial Day holiday and will make a recommendation to the governor Tuesday.
Mr. Perry also can grant a one-time, 30-day reprieve. That option, too, is rarely exercised.

Along similar lines, two 21-year old males who shot and killed a young store clerk during an armed robbery, were convicted in Texas of capital murder, but evidently the prosecution wasn't going for the death penalty, so these two got life sentences. The only difference I can see is that Beazley killed the father of a judge. So he gets death. Oh, another difference is that the two 21-year-olds were not black.

This case has generated more than the usual amount of publicity not because of the perp's age but because the victim's son is Michael Luttig, a Judge on the U.S. Court of Appeals for the Fourth Circuit, who also happens to be on the short list of candidates for the next Supreme Court vacancy. No doubt, if he is nominated, some Senator will have the poor taste to ask him a question about the case of his father's murderer.

One of the leading prosecutors who worked this case here in Tyler has a letter from Justice Scalia thanking her for the work she did on the case. This thug needs to die.

But he was only 17 at the time... a yute! Now, at 25, he is a savvy killer, adept in the legal system.

That's the definitive line for me right there, dudes and dudettes... This is one case where the SPIRIT rather than the letter of the law should be followed...
