At last FReep that I was at, 4/5/02, I was approached by FreemanZ, a local communist photographer.

It seems that several months ago, one of our fellow FReepers linked several pictures, of me and the ElectricStrawberry, and posted them on his web page. FreemanZ is claiming copy right infringement and wants me to stop these actions.

I am just a member of this board and have no influence on the actions of those who are members of this board, how should I respond?

He wants me to address this on an open forum, how shall we do this?

I know more about this person, I am a collecter of trivia, than I would ever want to know, one of his fellows dimed him out, what does one do?

Tell him that simply being in a photograph does not make you responsible for someone else posting the picture. Tell him to contact the FReeper in question.

Well, shucks, if he's a communist, how can he legitimately claim any copyright infringement. Shouldn't he WANT to share the fruits of his labors with the masses for no compensation?

He is participatory in this so-called infringement, since all he need do is change the name of the photo and the link goes dead.

He is 100% culpable in the distribution of this photo.

Are you trying to say that this FreemanZ is saying that a picture of you is copyrighted by him and it was used by this ElectricStrawberry group in a web site? Exactly how does he think that you have any control over someone else posting this picture?

The photograph must be hosted somewhere. If this commie ahole is hosting the picture, he is in control of the picture name. If this commie ahole is in conrol of the picture name, he should change the name of the photo on his hosting location. If he fails to change the name, he is tacitly giving his approval for said linking, since he is aware certain people are linking to his photo.

If he has the photos posted with a copyright on his site then displaying them without consent or appropriate credit may be in violation of some sort of law. If it's not your site they are being displayed on then you are not responsibile and he needs to contact the right person.

BTW: Does he have your permission to display photographs of you and ElectricStrawberry ?
