Bush Justice Department's Actions Protect Convicted Felon Who Violated National Security

Judicial Watch To Appeal Lower Court's Grant of Bush Administration Request

(Washington, D.C.). Judicial Watch, the public interest law firm that investigates and prosecutes government corruption, has been litigating defamation lawsuits against convicted felon Wen Ho Lee and others who, to deflect blame for their own actions, slandered and libeled Trulock. Specifically, as part of a media, public relations campaign, these defendants claimed in widely published reports that Trulock had singled Wen Ho Lee out for prosecution because he is ethnic Chinese, a variation of the O.J. Simpson defense. As a result, Trulock, a hero who blew the whistle on the biggest breach of nuclear security since the Rosenbergs at Los Alamos National Laboratories, lost his job and had his reputation destroyed.

A later government report which issued in Judicial Watch's litigation on behalf of Trulock proved that he had not engaged in “racial profiling.” Nevertheless, Wen Ho Lee recently published another defamatory book making these and other claims, further damaging Trulock, who is now destitute and penny-less. It hit the bookstores on January 15, 2002.

During discovery in the cases brought for Trulock, Judicial Watch obtained admissions from Wen Ho Lee that he had never been discriminated against, and did not even know what racial profiling is. Further, he was forced to admit that the government had valid reasons to investigate him.(emphasis added)

Nevertheless, just days before trial, which was scheduled to begin February 19, the full weight of the Bush Justice Department was used by the administration to intervene in Judicial Watch's private cases for Trulock, to argue that if the trial was allowed to proceed, that national security would be violated.

The lower court granted the Bush Justice Department's request to stop the cases this afternoon, on the eve of trial. Judicial Watch will appeal on behalf of Trulock.

Already, another case filed before the same court, the U.S. District Court for the Eastern District of Virginia, which was dismissed, has been reinstated by the Fourth Circuit. This reinstated case involves Trulock's claims against former FBI Director Louis Freeh for violating his constitutional rights.

“The Bush Justice Department feared that if the Trulock defamation cases went to trial that it would be embarrassed for allowing Wen Ho Lee to violate national security, and for this reason conjured up a bogus argument, backed by secret CIA affidavits submitted to the court ex parte, that trying this simple defamation case would itself breach national security. This action by the administration amounts to a cover-up of the negligence of the FBI, which allowed Wen Ho Lee to pick the pockets of the American nuclear arsenal. To this day, Lee cannot account for the whereabouts of the secrets he stole,” stated Judicial Watch Chairman and General Counsel Larry Klayman.

Well, it's a good thing to know that GWB will look into all the OTHER Chinese spying scandals instead....

This is indeed a scandal - a DOJ and DOE scandal. It is about incompetence and glory seeking - and has nothing to do with the Chinese - except that the incompetent power grabbers are doing a wonderful job feeding on YOUR paranoia about Chinese under your bed to promote their own interests - which are not, sorry to say, altruistic patriotism.

To sum up, the data Dr. Lee downloaded were not classified at the time of download, but were re-classified after the fact.

That's because Richardson and O'Leary declassified everything inappropriately during their tenures.

Well folks, I'm still here. Couldn't let this pass without adding my two cents. First, Larry Klayman did a great job on this for me. The old saying "hard to fight city hall" is truer than ever. Second, it should be plain to all that the Justice Department and the FBI want to bottle up any public discussion or hearing on the Wen Ho Lee case. And that is regardless of Administration. Lots of Clinton holdovers left in the Bush administration and they came to the front in this case. Both at Justice and also at Energy. Consequently, there was lots of collusion between the government and the defendants - mutual objectives. The defendents knew there was no evidence of racism or any other of the smears in the "classified documents." Clinton holdovers poured though the classified holdings looking for anything that could help Lee, etc. When they couldn't find anything, these people (DOE and Justice) simply claimed that national security would be damaged, etc. Pretty slick, huh? So get off of Klayman's back, on this case, he did everything he could to win...especially when no one else in Washington would touch the case...or me. Regards to all.

Thanks for giving us your first-hand perspective on this; but I'm not letting Bush or Ashcroft off the hook. They are well aware of the treason that went on, and they have done nothing but aid and abet it. And now they are sending a very clear message to any "would-be" whistleblowers.

I don't see any reason why I shouldn't assume that the treason continues.

I find it hard to separate the 'scandals' of the DOE and DOJ in this being separated from the accusations of treason brought against the Clinton Admiistration that we here on the forum SCREAMED ABOUT FOR YEARS to get anyone to pay attention to. Now that we have REPUBLICANS in the White House and in the Department of Justice, explain to me why NONE of the Clinton/Chinese scandals, INCLUDING THE REASONS FOR IMPEACHMENT BROUGHT AGAINST CLINTON BY DAVID SCHIPPERS ET AL, are not being investigated by 'our' people??

Paranoia? No, I'm just paying attention.

Almost all of Judicial Watch's lawsuits are dismissed before they even go to trial.

Unfortunetly this seems to be the case ... at one time (going back at least two years) I was a regular contributor to JW. What I began to see was more JW hype than results ... and having practical business sense I stopped sending in good money after bad. One case, for some reason, that irked me a great deal ... the Kenneth Bacon lawsuit, the liberal Clintonista worm at Pentagon who illegally released Linda Tripp's personal records to the media, who walked away unscathed. Then there was e-mailgate ... another JW lawsuit that, as far as I know, has gone nowhere.
