ON the face of it it seems like yours is a natural conclusion but sadly Americans are soft and years and years of liberal laws will ensure he will be marked as mentally unfit to stand trial. That is my theory and I dont agree but sadly this America we are (not us freepers )has alot of work to do to get over the last 30 years and sadly 9-11 may not have been enough.

little johnny jihad should be handed over to the northern alliance since in actually he is their pow....don't care what happens to him after that..but as i said on an earlier thread..no prison in the U.S. will be safe for him and if he beats the rap..too many hrs of video of him helping the enemy (U.S.) and if there are sleeper cells here, he will die a very grusome death...either way he is a dead man!!!

He should have been treated as an Afghan citizen and treated as any other POW and left in Afghanistan. That's the worst punishment I can think of.

A yes answer to both of those questions makes it treason punishable by death.

not to rain on your lynch mob, but unless you re-write the constitution, there is no way he can be tried for treason;
a: He was with the Taliban long before Sept 11,
b: The US has not declared war against Afghanistan,
c: There is no evidence he was intimately involved with al-Qaeda or was involved in the terrorist attacks
Unless you declare war on Afghanistan and re-write the constitution to make treason retro-active, there really isn't all that much you can do to him.
Realistically, he will probably be tried on some generic federal conspircy charge, spend a few years in jail and be released and eventually pardoned by some future administration, Tokyo Rose was pardoned by President Ford.

I rather like the punishment described in Edward Hale's classic story,
The Man without a Country.
For any of those whose public school educations did not include reading the classics, the main character was being tried for treason and uttered the line, "D---n the United States! I wish I may never hear of the United States again!" As punishment, he was ordered to spend the rest of his life on naval ships, transferred at sea from one ship to another to prevent him from ever landing, with the crews ordered never to mention the United States or to provide him with any news of what was happening there.
I understand that John Walker Lindh is currently being held in a cargo container on a U.S. ship. That's a good place to keep him for the next 50 years.

The statutory punishment for treason in England from 1283 to 1867, Drawn and Quartering was a multimedia form of execution. First the prisoner was drawn to the place of execution on a hurdle, a type of sledge. (Originally he was merely dragged behind a horse.) Then he was hanged. Cut down while still alive, he was disembowelled and his entrails burned before his eyes. (Some references, such as the Encyclopedia Britannica, say this step, and not dragging behind a horse, is what is meant by "drawn," but actual sentences of execution don't support this view.)
Finally the condemned was beheaded and his body cut into quarters, one arm or leg to a quarter. How exactly the quartering was to be accomplished was not always specified, but on at least some occasions horses were hitched to each of the victim's limbs and spurred in four directions. An assistant with a sword or cleaver was sometimes assigned to make a starter cut and ease the strain on the animals. The remains were often put on display as a warning to others.
