The intruder was armed with a weapon. The men defended themselves, but according to Mr. Der's attorney: "Maybe the grand jury thinks they shot him too many times."

Under Maryland law, a person can use deadly force if that person has a reasonable belief that his or her life is in imminent danger and if he or she uses no more force than reasonably necessary.

OY VEY!!!! The Grand Jury wasn't there! It was pretty well determined that that Tygon Walker was at the warehouse to steal whatever he could and to KILL anyone who got in his way!

When you feel your life is in danger, sometimes you're not always really worried about what a Grand Jury will think if you fire just one more shot to make sure the b****** doesn't get up and lunge!

Cops often shoot people "too many times," there's nothing wrong with unloading a clip into someone. If you're justified in shooting them once, you're probably justified in shooting them ten times.

Kenny Der and Darrell R. Kifer, both 35, surrendered to police yesterday and were in custody last night, said Deputy State's Attorney Haven H. Kodeck. They will be arraigned Jan. 18.

Correct me if I'm wrong, but they might get bail, but only after arraignment? Based on my calculations, that's fifty days in jail for (presumed) innocent men.

While it is better to be judged by twelve than carried by six, the state of Maryland is making that a less and less clear choice. That state's law must be changed, immediately and post haste, to get rid of this 'proportionality' requirement. Fear for life is worth using deadly force, whether it be one Bad Guy with a gun, one Bad Guy with a knife, or four Bad Guys with baseball bats.

They should have done what the mafia would do in a situation like this: Don't call the cops and bury the intruders body underneath the warehouse. This is called street etiquette. (keeps the honest law abiding citizen out of unnecessary trouble with the twisted laws of Maryland.)

Use only as much force as necessary to gain control of the situation. Force (violence) beyond that is unwarranted and probably illegal. Neither the law enforcement people or any invividual is judge, jury, and executioner.

Yet law enforcement types are trained to make multiple hits to eliminate the threat. I have read many articles and books on self defense. Most of these recommend multiple hits to eliminate the threat.

Also, it's obvious the Grand Jury has never been mugged.

This was not the first time the warehouse had been broken into either.

Baltimore has become a first class sh*t hole thanks to Kurt Schmoke [the last mayor] who destroyed a pretty good renaissance the City was having.

Ol' Kurt instituted the clean needle exchange program for the junkies. He just couldn't figure out where the junkies got the money to buy the dope they put in the clean needles. That's what a liberal arts degree from Harvard will do for you.

What a shame, someone needs to instruct the Maryland legislators on Castle Doctrine. In FL it applies to both home & business. Had this happened in FL, the State Attorney wouldn't have given it a second thought. Folks who intend to use deadly force need to learn the laws of their state and change them as required.

The article doesn't state what the races are. It's well know the state of Maryland is extremely anti-Second Ammendment. Or this could be a combination of both issues.

I do know this about Baltimore, the ethnic group on the Southeast side overtly did not appreciate a South Carolinian driving their streets with a Confederate Battle flag plate on the front of the car. I was cursed at and yelled at. Baltimore is not a place which celebrates diversity.

Also, they will be sued by the "perps" relatives(the latter will come out of the wall e.g. 46 brothers and sisters, and 19 mothers and fathers). The judgement against them by a "diverse" jury will be in the range of $145,000,000.
