SO ON TUESDAY AFTERNOON, December 12, Gore decided to write an Op-Ed for The New York Times, on the assumption the Court would rule in his favor. “As I write this,” the piece began, “I do not know what the Supreme Court will decide.” Gore repeated the themes of the five-week post-election struggle: count all the votes “so that the will of the people” was honored; work “for the agenda that Senator [Joe] Lieberman and I put forward in the campaign,” which “50 million Americans” supported; and appreciate that history and the “integrity” of the national government demanded he fight on after Election Day.
Gore acknowledged that “no single institution had been capable of solving” the electoral standoff and that this resulted in “continued uncertainty.” But the greater good, he contended, was being served. Invoking Lincoln and Jefferson, he mused on the “consent of the governed” and the “wellspring of democracy.” Jefferson had “justified revolution” because the people of the colonies had not given their consent. How could the U.S. Supreme Court justices “claim for themselves” the right to determine the presidency? It was up to the people. He concluded by quoting Lincoln’s First Inaugural, delivered a month before Fort Sumter: “Why should there not be a patient confidence in the ultimate justice of the people?”
It was only a draft, and Gore might’ve toned it down before publication, given its intimations of revolution and allusions to the Civil War. But it was strongly worded, all the more so as the justices had Bush v. Gore in front of them. The vice president phoned Walter Dellinger, a former solicitor general under Bill Clinton, for counsel. “I’ve spent the last few hours writing an Op-Ed for tomorrow’s Times,” Gore told him. “I want your judgment on whether I ought to run this or not.”
Dellinger liked it, suggested some changes that Gore punched into his laptop, and they were done. Gore said he would send it to Bill Daley, the campaign chairman, for one last look. “Is there anything else I need to think about?” he asked Dellinger.
“As a lawyer, I wouldn’t write an Op-Ed on a case I’d argued that was pending. But, then, you’re not the lawyer. You’re the client, so there’s no rule about keeping silent.” Dellinger then added, “But still, you should be thinking about whether running this would provoke the Court.” After all, it was Gore who’d told aides after the recounts were halted over the weekend that no one in the campaign should “trash” the Court. Might this Op-Ed be regarded as the velvet-gloved equivalent?
“O.K., let me think about it.”
Gore paused for only seconds, then made up his mind. He chuckled. Said the vice president of the United States about the Supreme Court: “——’em.”
Now the Op-ED never ran. But the reaction of Algore staffer's to the Vice Perpetrator's brazen remarks regarding the High Court?
The few people in Goreworld who heard about his remark had the identical reaction: if he had only shown that kind of animation during the campaign, he wouldn’t have been in the position of having to make the remark.
That is the man who wanted to be President. Total disregard for anything resembling the rule of law.

I like the part of .....a little quake relieves the stress, and perhaps spares us a larger one.
I can compare that to...(& I'm very serious)....a woman has a good cry....I mean a really good cry..which relieves stress, and prevents her (perhaps) becoming more stressful & having a nervous breakdown or something :))

Disposable, heck, if I told you all the times I went into a book store and could have spent the entire paycheck, if the thoughts of hunger/homelessness hadn't stopped me ...
What frosts me is not so much this - that became self-evident during the Battle of Florida - but that Kaplan writes as if this approach by Algore showed support for our Constitutional processes; that is was somehow alright for candidates to reinterpret ballots cast inumerable times regardless of whether those ballots change their form due to handling. Etc. I really don't what to get into all that stuff again. Too painful.
Bill Sammon nailed it with the title of his book - "At Any Cost". And I'm not sure even Mr. Sammon understood exactly how much he nailed it; here's proof.
Exactly! I lugged six books with me on my trip to Alaska and even with the excitment of just "being" and all of the entertainment on the ship and on land, I found time to demolish all of them. Actually, when I have forgotten to bring along a book, I've stooped to reading matchbook covers.
Of course not. The electoral colllege wasn't able to execute is resolution until December 18th. It wasn't impotent, just not prematurely come to bear.
Eight SCOTUS Justices agreed that SCOFLAs ruling was wrong. Stevens concluded it was rude to say so.
Seven SCOTUS Justices agreed that it was unconstitutional. Among other things, Ginsberg ruled that even if wrong, because it was a court doing it, no matter how far afield the ruling was, it could not be considered "making law".
Five SCOTUS Justices ruled that SCOFLAs ruling on the 12th of December being a deadline for non-legislature action in appointing a slate of Electors was legal. Ginsburg, Stevens, Breyer, and Souter wished to overturn only this limited portion.

Seriously, I'm wondering if anyone in the media has ever figured out, much less reported, that the Supreme Court decision was 7-2 ..... that the 5-4 was about the remedy.
And I'm also wondering if Justice Kennedy is going to speak about about this newest bunch of garbage.
And one more thought on the subject ..... aren't the SC members supposed to stay above politics? And isn't this Newstweak article definitely in the realm of politics? ARRRRRRRRRRRRRGGGGGGGGHHHHHHHHHHH!!!
I've been trying to stay away from the tv sets today so I wouldn't break them all ..... but I did happen to catch a few minutes of the President's talk in Jax, FL on education.
Didn't hear it all but he stressed again that the lousy education system leads to that "soft bigotry of low expectations" and reiterated that he does NOT, will NOT ever favor the federalization of the education system. Each school system has its own needs that it can best work out in its own district. He's strongly in favor of LOCAL control ...... the best way to solve the probs. YAY!!!!!
