Outrage as serial rapist Max Factor heir is sprung from prison early... but is banned for life from California town where he preyed on women

Disgraced Max Factor heir Andrew Luster has been banned for life from the California county where he carried out multiple rapes in the late 90s, the Daily Mail has exclusively learned.

Pervert Luster, now 62, was sprung from prison last week and is living in a modest $700,000 bungalow in the small city of Glendora – 25 miles east of downtown Los Angeles.

But while the serial predator has been cut loose, the Daily Mail has learned that his freedom has come with severe conditions, including three years on parole, a life ban from Ventura County and an ankle monitor that has to be worn 24 hours a day.

He is also banned from coming within 35 miles of the homes of the women he raped – meaning he now lives on the eastern side of LA County, well away from Ventura and Santa Barbara counties where some of the women still live.

Luster was convicted in absentia on 86 counts of rape in January 2003 after fleeing to Puerto Vallarta, Mexico, having been charged with drugging and raping three women – all of which he filmed for his own gratification.

He was famously dragged back to California by Duane ‘Dog the Bounty Hunter’ Chapman in June the same year and handed a 124-year sentence for his crimes.

But in April 2013, Ventura County judge Kathryne Stoltz slashed his prison term to just 50 years on a legal technicality, saying the original judge failed to state specific reasons for handing him consecutive prison terms.

Then, in 2016, came Proposition 57 – a rule change championed by then Governor Jerry Brown and then attorney general Kamala Harris, which mandated that non-violent offenders should serve just half of their prison sentence.

Drugging and raping women is "non-violent"? I doubt the victims would agree with that.

Rape is a violent crime, in this case he should never be let out of prison.

___________

How is serial rape considered non-violent?

Here’s why, but California in 2024 reversed course and made it violent again:

Why Certain Rapes or Serial Offenses Are Classified as Non-Violent

• Incapacity and Lack of Physical Force (Date/Drug-Facilitated Rape): In jurisdictions like California (prior to recent legislative changes), legal statutes for a “violent felony” historically required proof of overt physical force, violence, or the explicit threat of violent retaliation. If a serial rapist targeted victims by rendering them unconscious or incapacitated via alcohol or drugs (rather than using overt physical trauma or a weapon), the specific statutory definition of the crime was sometimes categorized legally as non-consensual sexual assault or non-violent felony rather than a designated violent crime.
• Sentencing and Parole Loopholes (e.g., Proposition 57): In some legal systems, ballot initiatives or sentencing reforms (such as California’s Proposition 57) defined “violent felonies” strictly based on a narrow enumerated list in the penal code rather than the nature of the act itself. Because certain non-force-based or incapacitated sexual assaults were omitted from that specific violent-crime list, perpetrators convicted under those clauses became eligible for non-violent parole timelines.
• Criminological and Behavioral Profiles: Research by organizations like the FBI’s National Center for the Analysis of Violent Crime notes that some serial rapists rely on criminal sophistication, surprise, verbal coercion, or psychological control rather than extreme physical battering during the assault itself. Criminological studies sometimes differentiate between “violent” crime scenes (where severe physical trauma occurs) and “sophisticated” or stealthy crime scenes, though criminologists emphasize that the act of rape is inherently a violation of bodily integrity.

Legislative Changes

• Closing Loopholes: Lawmakers in states like California have moved to close these distinctions. For example, California Senate Bill 268 was signed into law to reclassify the rape of an unconscious or drugged person as a violent felony, reversing previous classifications that allowed early parole tracks for such offenses

California once was a great place. They built great machines and beautiful dreams. Now, it is just a tawdry, sick joke.
