Feds busted Los Angeles medical fraudsters accused of stealing $2 billion Thursday, cuffing white-collar thieves for unneeded surgeries, hunting the homeless for rehabs and billing the government for phony hospice care.
Department of Justice officials charged 15 defendants in all, including medical professionals, for making fraudulent claims to government and private health care programs – including $1.6 billion sham rehab case, the largest of its type ever.
Federal SWAT teams sought their suspects in a series of predawn raids, targeting high-class criminals such as Dr. Hany Malek, 61, an allegedly armed-and-dangerous chiropractor accused of keeping an arsenal in his $2 million Tarzana mansion.
“Come out with your hands up,” called an FBI agent in the huge, gun-toting team of camouflaged officers who encircled Malek’s massive suburban home with a swarm of armed vehicles.
Agents cut Malek’s security gate and placed ladders against his tall fences, training guns on his home. Three flash-bang grenades exploded and sirens were activated.
After a few moments, the FBI brought their man down in handcuffs and placed in him an armored truck.
Malek is accused of working with Dr. Harold Tabaie, 78, of Anaheim, a cardiothoracic surgeon, of stealing $134 million in fraudulently billed to Medicare claims for unnecessary atherectomy procedures that resulted in injury to patients.
Authorities say Malek posed as a medical doctor and diagnosed patients with arterial disease, recommending that they receive the invasive procedure in which a bladed catheter is used to clear plaque from arteries.
Tabaie then performed the procedures on patients who did not actually have disease, executing repeat atherectomies on some who he previously treated unsuccessfully with the procedure, prosecutors say.

Malek aye?
Freeze all assets and recover as much as possible.
Seems like they could have had a "Say hello to my little friend" moment.
Near as I can tell, the entire medical industry has restructured into a machine for billing medicare as much as possible.
These sound like the villains who made The Joker! The Armed-and-Dangerous Doctor of Osteopathy and his Cardiothoracic side-kick!
Seriously, the Federal Government needs to get out of medicine. The money is just attracting the worst.
Near as I can tell:
MONEY STILL TALKS
Imagine health insurance being a commodity on the open market. Not tied to any job, not connected to any government. Whichever state you live in, just shop for heath insurance -- small local brands? Big national brands? Just find the best deal and let the marketplace keep prices low.
And you can bet that insurance companies in a competitive marketplace would make sure that no one was ripping off the system for $2B at a time. Corporate accountants tend to keep an eye out for stuff like that.
About 28 years ago, in Atlanta, a friend who worked in corporate finance briefly worked for an accounting firm in Midtown. When I visited her office one day, I noticed a consulting group next door on her floor and asked her, “What do they do?” She said they were a sister organization to her accounting firm and traveled around the country to train billing coders for medical practices. AI handles this today, no doubt, but back then they built a thriving business teaching others how to code procedures to maximize revenue and minimize audit challenges. It was an industry in itself. The bureaucracy that is necessary to spend that much money is necessarily sloppy enough to waste so much that it cannot see the fraud.
Imagine paying a doctor to fix something wrong with you.
He may not even have time to practice on monkeys to cut the junk off of kids!
Somehow I don't think the founding fathers envisioned the federal government as a health insurance company or a national landlord.
Since California Gov HairGel signed the Nick Shirley Act to prevent uncovering fraud, will he attempt to block the Feds from indicting California Fraudsters?
Why is anyone getting surgery from a chiropractor?

WHOA! One of the men arrested this morning, Hany Malek, has a nearly 2-decade history of fraud!
In 2008 Malek was accused by his business partner, Michael Koshak, of using a network of at least 18 bank accounts, 5 federal tax identification numbers, and 12 names to carry out and conceal fraud involving their medical business, Choice Providers.
After a court-appointed receiver took control of the business, Malek violated the receivership order and was found guilty of 10 counts of contempt, receiving a sentence of 50 days in jail, $10,000 in fines, and payment of the receiver’s attorney fees. The trial judge also ordered him to return approximately $1.7 million, including interest, based on findings that he had diverted business funds, including by selling receivables.
Yes, but does it have to shout?

The Founding Fathers gave Limited Government a good run. We have destroyed it, as I am sure they knew we would.
Are these ones going to have to serve the terms they are given or with they wipe out another $2B in fraud repayments with pardons and clemency.
Would be nice if the crime mattered, not who did it. Let every last one of them rot.
