Immigrants on work visas will have to immediately leave US if they lose job under new Trump DHS rule

WASHINGTON — Any immigrant legally in the United States on a work visa would have to depart the country immediately if they lose or quit their job under a new rule being proposed by the Department of Homeland Security.

The proposal would eliminate the 60-day grace period foreign workers receive when they become unemployed — allowing them to stay in the US to find more work.

Instead, the loss of employment would mean an immediate loss in legal status.

The DHS does not even track this. Ask any AI how many H1B visa holders left the country in 2023, 2022 or any other year. They don’t know. An H1B visa is a defacto grant of American citizenship. Big tech runs this section of the DHS and there is nothing anybody can do about it.

Yes. This makes harder for American workers to compete with them, and it will reduce the wages of American workers.

I’d rather the DHS did track these things. In the absence of that removing the 60 day grace period seems like a gimmick.

I have no problem with them having a small grace period to buy plane tickets home, end their apartment leases or sell houses, arrange cargo containers back home, etc.

The current 60 day grace period is not unreasonable, if it were actually enforced. Those with work visas xhould not be considered property of their employers.

I agree. I’d rather enforcement resources go to illegal aliens and intentional visa overstayers rather than someone who got laid off on a friday and can’t find a flight out that night.

Good. Another positive step. Again, not huge but like no longer allowing H1B’s spouses to work and slapping a big fee on new H1B applications, this too will help.

We still need a big fee on H1b Renewals but I’ll take every positive step I can get.
