Johnson County judge strikes down Kansas abortion restrictions

KANSAS CITY, Mo. — A Johnson County, Kansas, judge has issued an order that permanently blocks the state from enforcing certain abortion restrictions.

In his opinion issued on Monday, Judge K. Christopher Jayaram – who was recently appointed to the Kansas Supreme Court – said the proposed restrictions violate a woman’s right to bodily autonomy, as guaranteed by the Kansas Constitution’s Bill of Rights:

Because a woman’s right to bodily autonomy (including her right to decide whether to terminate or to continue a pregnancy) is fundamental, the Court concludes, given the overwhelming evidence adduced at trial, that the State’s rationale and legislative schemes…simply do not, in significant part, survive constitutional scrutiny under Section 1 of the Kansas Constitution Bill of Rights.

The court used a “strict scrutiny” standard with this case, and the judge said the defendants “simply failed…to justify such intrusive legislative mandates.”

Judge Jayaram said it wasn’t even a close call. Therefore, the state of Kansas cannot enforce the following abortion restrictions:

* Requiring patients to provide a reason why they are seeking an abortion

* Waiting periods under the Woman’s Right to Know Act, including the 24-hour waiting period and the additional 30-minute waiting period after the in-person consultation before an abortion is performed

* State-mandated disclosure at least 24 hours prior to an abortion detailing the risks related to the abortion method and the gestational age of the fetus, among other things

* Disclosure that it “may be possible” to reverse a medication abortion

When it comes to abortion pill reversal (APR), Judge Jayaram said, “APR theory is just that: an untested and experimental idea with no legitimate grounding in existing, validated, peer-reviewed scientific processes or mainstream medical practice.”

Here’s a link to the State of Kansas Bill of Rights. There is nothing in there about a guarantee of bodily autonomy.

Okay, is he a Johnson County Judge, or is he one the Kansas Supreme Court? The article is quite ambiguous on this.

But it is just fine to let unwed mothers sue for child support without any marriage contract for government to enforce, without any law saying life begins at conception, and without any regard for male 4 th and 5th amendment rights.
Females are not held responsible for getting pregnant, but males are blamed and forced to pay damages for getting them pregnant, even though it is the female who chose to have the baby and keep the baby.
One judge has no right to decide this issue and in effect, illegally amend the Kansas Constitution to put state licensed medical doctors above the law.
The bodily autonomy argument is about using a coat hanger, but the judge just deregulated state licensed medical doctors and made pregnant females the LAW. …a corruption of the medical profession. Doctors do not have license to kill, and medical doctors are not part of a woman’s body. Rewrite laws and revoke medical licenses. Laws banning or restricting abortion are aimed at medical doctors, not pregnant females. This judge is just mired in the pile of bs that Roe versus Wade was built on.

How about jumping off of the Golden Gate bridge. Isn’t suicide body autonomy too? Govt will try to stop you.
