The 85-year-old doctor, once the head of the government’s covid response, now faces mounting congressional threats and legal risks.

Anthony Fauci didn’t know Rand Paul had his diary, let alone that the GOP senator was going to release it, his friends said.

So last Saturday — after the Kentucky lawmaker had publicly shared years of Fauci’s private reflections, on everything from fighting covid-19 to attending “A-List” events — Fauci went to another party.

There, at a birthday celebration for former White House chief of staff Ron Klain, Fauci mingled with friends and former Biden administration colleagues. They cheered and toasted him, apparently unaware that his critics were combing through documents that would kick off one of the most fraught weeks of his decades-long career.

For a few hours, Fauci was back inside a familiar Washington.

Then reality intruded. His longtime critics now control congressional committees, the health agencies where he spent his career and the Justice Department that could ultimately decide whether to prosecute him. After years of promising to hold Fauci accountable for the government’s pandemic response, they are flexing their power to try.

The past week offered the clearest glimpse yet of what that reckoning could look like.

On Monday, Health Secretary Robert F. Kennedy Jr., a longtime Fauci foe, bragged about his department’s months-long efforts to scour 11 government servers to reassemble Fauci’s diary and turn it over to Paul. On Wednesday, Fauci faced hours of questions from Paul and fellow Republican senators at a congressional hearing Fauci and his allies believe was designed to entrap him. He invoked his Fifth Amendment right not to testify more than 100 times.

Fauci’s presidential pardon gives him great protection.

But someone on another thread mention this:

You cannot invoke the 5A if you have been given immunity from prosecution based on what you say. So give Fauci that immunity. Then wait until he perjures himself. An immunity agreement would not cover that.

I’m not a lawyer. But that approach does make sense.

They’ll never get him to admit the treasonous things he did to the US. But they can easily determine the illegal use of the 5th as a contempt of congress and present penalties. If the individual is prosecuted and convicted, violations of § 192 are punishable by a fine of up to $100,000 and imprisonment “for not less than one month nor more than twelve months.”

But it beats being guilty of treason. Under 18 U.S. Code § 2381, the punishment for treason is death, or imprisonment for not less than five years alongside a fine of at least $10,000, plus a permanent ban on holding any federal office. So he’s choosing the lighter of two possibilities as his treasonous acts killed thousands of people throughout the world. Unlike Hitler, he has an escape possibility of the death penalty with contempt.

Fauci is potentially subject to state prosecution, of which Florida is attempting to do.

Fauci has the right to invoke the Fifth and not be prosecuted for doing so.

The Senate can get the Wuhan grant files by asking for them or subpoenaing them.

Fauci backed Trump’s efforts to make COVID vaccines available.

Neither should be prosecuted for those efforts.
