The following offering on the “birthright citizenship” decision in Trump v. Barbara picks up where your humble servant’s initial offering left off.
Specifically, it will address in greater detail the remote – yet now thanks to the Barbara decision – actual potential for the neutering of the Constitution’s “natural born Citizen” (“nbC”) presidential eligibility restriction, at least as understood by the Founders. Interesting, I watched the Sherlock Holmes series Elementary last night. That show ended in 2019 and was well done up. Last night Holmes explained where and how the term “86” originated (during the Prohibition era and people had to flee police raids).
It means to “disappear” people, Holmes said.
Under the ‘Barbara’ ruling, Congressional acts on immigration stand where they address the issue of location of birthplace.
In the 1952 Immigration Act, section 202 added the “Asia Pacific Triangle” restriction. This required a separate petition for a quota slot for legal entry to the USA, and was specifically applicable to children born within the USA (if they were born to non-citizen parents and were 50% - or greater - of descent from an Asian country).
That situation applied to Kamala Harris, so even with the ‘Barbara’ decision, she remains a non-NBC (at the time of her 1964 birth).
Well, Get Smart did run on NBC for four seasons. Maxwell Smart was famously Secret Agent 86.
