Appeals Court Lifts USPS Mail-In Ballot Block, in Win for Trump

A federal appeals court on Friday cleared the way for the U.S. Postal Service to continue developing a Trump-backed rule that could sharply limit mail-in voting, temporarily staying a nationwide block issued weeks earlier by a district judge who found the proposal breached a 2021 settlement with the NAACP.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit granted the Postal Service's motion to pause a July 1 injunction from U.S. District Judge Emmet Sullivan, a Clinton nominee.

Sullivan had concluded the proposed rule violated the settlement's requirement that the Postal Service take "extraordinary measures" to deliver election mail through 2028.

The panel found USPS likely to succeed on two grounds, ruling the NAACP's challenge is "likely neither constitutionally nor prudentially ripe for review" because the rule has not been finalized, and that the proposal likely would not breach the settlement even if adopted.

It also credited the government's warning that leaving the injunction in place would prevent USPS from issuing a final rule before the November election, Democracy Docket reported.

The proposed rule flows from President Donald Trump's March 31 executive order, "Ensuring Citizenship Verification and Integrity in Federal Elections."

It directs the Department of Homeland Security, working with the Social Security Administration, to build state-by-state lists of verified U.S. citizens eligible to vote, and directs USPS to withhold mail-in and absentee ballots from voters not on those lists.

Under the USPS proposal published June 2, state and local officials would upload voter data through a federal portal, and every ballot envelope would carry a unique barcode tied to a specific voter.

Postmaster General David Steiner told a Senate panel last month the agency would refuse to carry ballots for states that decline to share voter rolls.

You need a proof of delivery receipt when a ballot is received by the precinct.

Otherwise you'll never know if your ballot was delivered...and hopefully counted. The numbers should add up.

What i want to know is if the USPS will have an accessible database of who voted by mail. I left Michigan for Virginia on New Year’s Day 2000. I am registered to vote in Virginia, and the nice DMV person who registered me when I got my Virginia drivers license in early 2000 assured me they had reciprocal agreements with Michigan which would result in me being removed from the voter rolls in Michigan.

Virginia has a lovely voter information system. I can log in and confirm i am registered, where I live and where I am registered to vote,and my entire voting history. Michigan has a similar voting system, and even has a link identified as ‘voting history’ but when you click the link it tells you to contact you local precinct to get voter records. Yeah. Like I’m going to do that.

It gets better. In 2020 I was sent a mail-in ballot - TO MY VIRGINIA ADDRESS. To be clear, in the system when I log in it still has my address at the location I lived in 1999. So how did it get to me in Virginia? And it wasn’t forwarded to that address. That’s the way the envelope was addressed - to Virginia.

So now I am hoping there will be a USPS database that will allow me to see if someone cast a mail-in ballot in my name in Michigan.

Thought the SCOTUS ruled that district judges can’t make a ruling beyond their own district.

It’s a good step. The USPS is taken out of the voting fraud. But it won’t matter in California. The Democrats will decide how many votes are needed, then stamp ballots with counterfeit post marks and deliver them for tabulating. An investigation will confirm that cheating took place. But an investigation can not prove who the votes were cast for. So, while it can be proved that cheating took place, the results will still stand unless courts nullify fraudulent elections and then require stringent procedures to eliminate the fraud. Good luck with that in California.

Maybe. But the USPS was complicit with the RATs in the 2020 steal, from Carriers to TPTB.

I don’t see this as a great victory. I could be wrong; we’ll have to wait and see. (Maybe PDJT has cleaned out the dreck at the PO and it’ll be OK, but I don’t recall hearing about it if he did.)

The DoD (and USPS) might use individualized postmarking stamps that include a 4-digit numbering stamp.

The Trump block would be applied to outgoing ballots.

They would be expeditiously returned to the sender.

The sender could then have the police deliver the ballots.

That NewsMax title is correct, and the title you propose is inaccurate. ABC News explains that there are two separate judges who blocked it and the Mass judge's order is under a separate court of appeals.

A federal appeals court in Washington, D.C., handed the Trump administration a temporary win on Friday in its attempt to increase federal oversight of elections. "In a unanimous ruling, a three-judge panel of the D.C. Circuit Court of Appeals put on hold a lower court ruling, which had blocked the U.S. Postal Service from attempting to restrict mail-in voting.

However, the Trump administration does not yet have a green light to move forward with the proposed rule. A separate judge in Massachusetts blocked the policy last month, and that injunction still stands."
