The Supreme Court on Tuesday allowed Exxon Mobil to sue state-owned oil companies in Cuba over the confiscation of property that occurred after Fidel Castro’s regime seized power nearly seven decades ago, letting the lawsuit proceed at a time when President Donald Trump has taken an aggressive stance toward Havana.
Justice Brett Kavanaugh wrote the opinion for a 6-3 majority with the liberal justices in dissent.
The decision is the latest development in an unusual confluence of legal and geopolitical moves Washington has taken to increase pressure on Cuba. The Trump administration indicted former Cuban President Raúl Castro on May 20 on charges that stem from his alleged role in the 1996 shootdown of two civilian aircraft that killed four people, including three Americans. Trump has also flirted with military action in Cuba, telling reporters in March he might have the “honor of taking Cuba.”
A day after the Castro indictment, the Supreme Court decided another case dealing with property seized by Cuba. In that decision, an 8-1 court allowed a lawsuit to proceed against the world’s largest cruise ship operators that had docked at Havana’s pier amid a thawing of relations during the Obama administration.
The Exxon case was also tied to property confiscated in 1960 shortly after Castro came to power in the island nation’s revolution and to a law Congress passed in 1996 allowing US nationals to sue over that seized property in US courts.
By the late 1950s, Standard Oil Company – later renamed Exxon Mobil Corporation – had extensive operations in Cuba, including a refinery, multiple product terminals and 117 service stations, all of which were seized by the Castro government and folded into state-owned enterprises.

Let the games begin - send lawyers guns and money
And hopefully the commie regime in Cuba collapses once and for all.
I wonder what the Cuban Supreme Court would say? LOL
I think it’s important to note that our embargo with Cuba is not simply because they are “communist.” It’s because US companies lost billions in assets with no compensation back in the revolution. Cutting Cuba off was a way to hurt them economically. We’ve done business with other commie countries; but they did not rob US companies of so much.
I hope we can get Cuba back on our side. I hear it’s a beautiful country and once the hotels are open to the US, it would be a nice vacation spot.
I like Cuban cigars as well. Although, DR and Nicaragua have stepped up their games.
It needs more than hotels, it needs infrastructure.
You’re right, Cuba desperately needs to infrastructure. If they were smart they would require hotel chains who want to open up operations in their country to invest some money into local infrastructure improvement projects as part of the deal. Having better facilities could be somewhat of a win-win for both parties as the hotels will want to provide modern conveniences for guests.
They'd 86 the socialism and partner with the U.S.
Oh I am sure. I cannot imagine if it was “opened” that there would not be billions flowing in within 6 months.
I will defer to others regarding the state of the infrastructure, but having built telecom systems getting ramped up these days takes a lot less time than it did in the 1980’s when we were building out the broadband systems across the US.

Expected, but still amazing.
It doesn’t matter what the issue actually is.
Those three: Yay socialism! Yay communism!
And the GOP had better get its act together. Today’s Democrats will absolutely pack the Supreme Court if given the chance. All it would take is a bill passed in Congress.
Trump’s veto will stop them for now.
But after Trump?
If it is truly opened, meaning they end the socialist government and incorporate a capitalist model. Friends visited a decade ago when the "opened" tourism to America (under Obama?) - said it was a dirty slovenly poor mess.
The older population is inclined to support the ‘revolution’. They’ve been brainwashed into believing socialism is good for them. Younger people seem to want change and closer relations with the U.S. Despite the deprivation and hardship, and a totally corrupt government, there still seems to a high level of national pride in the country so if anything, it will be more like cooperation rather than a partnership arrangement with the U.S. IMO.
Agreed
I could easily agree to that.
The commie black robes were against this. I’m so surprised.
After Trump, let’s hope there is another Republican president to veto packing the Supreme Court.
If Dems win 28 president and both houses of Congress, they will ram through things.

Right. It would probably take suspension of the filibuster. Which the D leadership would do in an instant.
Congressional Democrats play hardball.
Congressional Republicans play a gentle version of tee-ball.
Can the Mafia sue as well?
Cuba opening up might the final straw for Las Vegas.
How do you get blood out of a turnip.
