Nebraska Senate Candidate Dan Osborn Wants ‘Preemptive’ Mental Health Checks For AR-15 Owners

The independent challenging Republican Nebraska Sen. Pete Ricketts called for owners of modern semiautomatic firearms to undergo a mental health evaluation every five years as a prerequisite to renew registration of the guns.

Dan Osborn, who lost to Republican Nebraska Sen. Deb Fischer in the 2024 election, announced his plans to challenge Ricketts in July 2025. Osborn, who has received support from Democrats in his big to topple Ricketts according to Roll Call, suggested the measure during a town hall in June.

“I said, ‘Do you own an assault-style rifle, an AR-15, an M16, an AK-47, or anything like that?’ He’s like, ‘Yeah. I got a lot of them,’” Osborn claimed, according to the Plains Sentinel. “I said, ‘Let me ask you, would you have an issue with having to re-register those guns after taking a mental health exam—let’s say, I don’t know, just throwing a random number out there—every five years?’ He sat for a second and he said, ‘No.’”

Pro-Second Amendment organizations have opposed so-called “red flag” laws citing concerns with due process, with the National Rifle Association roasting Osborn’s proposal in a Tuesday post on X.

“Nebraska Senate candidate @osbornforne says he would support a gun registry, red flag laws, and a 5-year ‘mental evaluation’ for owners of America’s most popular gun platforms,” the pro-Second Amendment organization posted. “This radical view would grant government control over who can exercise their constitutional rights.”

“Given that there is nothing even remotely close to requirements like that in the historical tradition of gun control in this country at the time of the founding, that law would face aggressive legal challenges and should be struck down,” Second Amendment Foundation Senior Director of Legal Operations William Sack told the Daily Caller News Foundation. “The entire premise of fundamental rights is that you don’t have the burden of proof to prove to the government when you get to continue to exercise them.”

“Dan Osborn is pushing the agenda of his liberal donors. He wants to force law-abiding citizens to submit to government mental health exams just to keep firearms they already legally own,” Ricketts said in a statement to the DCNF. “This is an extreme position even among gun control activists. As senator, I’ll always defend Americans’ Second Amendment rights.”

Osborn said he supported the Second Amendment when reached for comment by the DCNF.

“I am fundamentally in favor of the 2nd Amendment for everybody,” Osborn claimed. “Those remarks were taken out of context by a fake news outlet that’s run by Pete Ricketts lackeys. That’s not something I support.”

Under Democrat control, no person could ever pass one of their mental health exams... except perhaps the women who have used abortions to improve their own mental health.

The first rule of gun control is to NEVER let the government control your guns.

Does anyone else here see the irony of leftists being in charge of deciding what constitutes mental illness?

It would just be the first step putting political dissidents into mental institutions. As was done in the Soviet Union and most other totalitarian regimes.

Anything like that? I can throw rocks pretty fast does that make them assault rocks, or maybe knives.

Assault rifles are often misunderstood and misrepresented in public discourse. Technically speaking, an assault rifle is defined as a fully automatic weapon, which means it can continuously fire rounds as long as the trigger is held down.

While legal on a federal level, automatic weapons are completely banned for civilians in some states. Additionally, states that do allow them may have further restrictions on their storage and transport.

If you are looking to acquire a legal, pre-1986 machine gun, you must follow strict regulations set forth by the National Firearms Act.

Federal Tax Stamp: You must pay a $200 transfer tax for each machine gun.

Background Check: You must pass an extensive FBI background check, which requires submitting fingerprints and passport-style photographs.Chief Law Enforcement Officer (CLEO)

Notification: You must notify your local chief law enforcement officer of your intent to purchase.

Registration: The firearm must be registered in the ATF (Bureau of Alcohol, Tobacco, Firearms and Explosives) National Firearms Registration and Transfer Record.

Wait Times: The approval process requires significant processing time by the ATF.

And this is only at the federal level. Each state has different needs and some states do not allow you to own them:

California, Delaware, Hawaii, Illinois, New Jersey, New York, Rhode Island, and Washington, D.C.

On the other side, Nine states—Alabama, Kentucky, Mississippi, New Hampshire, New Mexico, Oklahoma, Utah, Vermont, and Wyoming—place no additional state-level restrictions on the possession, manufacture, or sale of automatic weapons.

One of the worst aspects of the current system is the widespread belief that a simple “mental health check” exists and can be used to promote public safety.

Normal people can spot a dangerous wack-job. There’s no medical aspect to that at all. Medically trained people can identify traits that are SOMETIMES (but usually not) associated with going postal.

In general, normal people should carefully judge associates using reasonable person criteria, and leave the medical system out of it.

In 119 Congresses I have found only one candidate that wanted a seat in Congress for a good reason.

He wanted access to the Library of Congress so he could read and do research.
