A senior police officer has praised the “impressive” efforts of an elderly man who shot an alleged intruder after he and his wife were stabbed at their rural NSW home.

Police allege the 75-year-old man and 72-year-old woman, identified as Keith and Dianne Blessing, were attacked by a knife-wielding man in their home at Torrington, a small village in northern NSW, just after midnight on Thursday.

Ms Blessing “collapsed with a chest wound” while her husband was slashed across his abdomen, police say.

Mr Blessing called triple-0 as their alleged attacker retreated onto the home’s veranda.

The alleged attacker can now be named as Joshua Dylan Trethewey.

Police say the 34-year-old was shot by the older man as he tried to get back into the house.

Mr Trethewey has been charged with two counts of causing grievous bodily harm with intent to murder and is due to front a NSW court at a later date.

If I’m not mistaken, gun ownership is a privilege in Australia, not a right.

So, a question. Can an Australian request ownership of a firearm for self-defense reasons alone?

I meant to include a couple more lines. Not sure how I got distracted.

“He certainly did his best under very difficult circumstances to defend himself and his partner,” Superintendent McKenna said.

“It was quite impressive, given the extent of the injuries that he suffered.”

Australian police aren’t always this clear and forthright in talking about people’s right to self defence. Even in cases this clearcut where Mr Blessing and his wife were both quite seriously injured.

“Joshua Dylan Trethewey”

Many pictures of the victims. Pictures of the perp, not so much.

Generally, no. The laws differ somewhat from state to state, but a general principle in law here is that a person has to have a specific reason to own a particular firearm. And self defence is, in most cases, not, by itself a valid reason. There are exceptions for a few people who face particular threats (mostly police officers and defence personnel but even there it's rare).

But if you happen to have a firearm for another reason, under common law, you are permitted to use it to defend yourself or another person if you genuinely believe you (or they) are in danger of death or serious injury if you do not (the common law principle is that you may use 'reasonable force' and if there is a risk of death or serious injury, any level of force may be reasonable).

That's why it's very unlikely Mr Blessing will be in any legal trouble. He is a licenced firearms owner and the injuries he and his wife received make the case for threat of death or serious injury pretty trivial.

But even in cases like this, the police have sometimes been known to take a while before they clear somebody. In this case, the Superintendent (quite a senior officer) seems to be making his position very clear very quickly.

Cops in Australia are praising a 75-year old for defending his wife and property with a firearm? Super cool but…I was told firearms were banned in Australia…? Were they granted an exception? Or is it legal for citizens to have firearms?

“He certainly did his best under very difficult circumstances to defend himself and his partner wife,” Superintendent McKenna said.

Elsewhere, the article also refers to "Ms" Blessing.

If it had been me, the dingoes would have feasted that night!

Guns are not banned in Australia. Never have been. But there are some fairly strict laws about who can own what. Universal licencing and registration among them. Law abiding citizens generally have no difficulty getting a licence to own basic non-semi automatic rifles and shotguns, but anything more powerful or handguns require a higher level licence. Again, not too hard to get a licence for a low capacity semi automatic, or a basic pistol, but anything high capacity or that is seen as military style starts getting much more difficult. Very few people can own anything automatic unless they have a specifically work related reason they need such a firearm.
