Justice Department Notifies Fairfax County, Virginia Commonwealth’s Attorney of Investigation into His Plea Bargaining, Charging Decisions, and Sentencing Policy

Today, the Justice Department notified the Fairfax County, Virginia Commonwealth’s Attorney Steve Descano of the initiation of a federal investigation into the Commonwealth’s Attorney Plea Bargaining, Charging Decisions, and Sentencing Policy. The Justice Department’s Civil Rights Division will investigate whether the Office of the Fairfax Commonwealth’s Attorney discriminated against United States citizens by offering preferential treatment only to illegal alien criminal defendants.

“Under my leadership, the Civil Rights Division will not allow local prosecutors to pick and choose winners based on their immigration status,” said Assistant Attorney General Harmeet K. Dhillon of the Justice Department’s Civil Rights Division. “This investigation will uncover whether this prosecutor is putting the community at risk in offering sweetheart deals to illegal immigrants charged with serious crimes.”

The Department has not reached any conclusions regarding allegations in these matters. The Department will investigate under various statutes, including Title VI of the Civil Rights Act of 1964, the Safe Streets Act, and law enforcement misconduct statute 34 U.S.C. § 12601. The Department has conducted similar investigations where violations have been found, and the resulting settlement agreements have led to important reforms.

"This @CivilRights is investigating Fairfax County for giving preferential plea deals to illegal aliens while discriminating against American citizens.

If true, this violates several federal laws—& DOJ will not allow state prosecutors to play favors based on immigration status."

Virginia seems to be having a particularly rough month of May.

Is this a case of karma? Or maybe FAFO?

I really like her as well. Very no nonsense and a bulldog when it comes to civil rights violations.

The DA literally posts on his website that immigration is taken into account for sentencing.

Wait ... aren’t we supposed to hate foreign born women involved in American politics?

If Fairfax County, Virginia Commonwealth’s Attorney Steve Descano and others in his office have shown plea bargaining favoritism to illegal aliens, then they may also need to be indicted and charged with giving aid and comfort to the domestic and foreign enemies of the United States.

I don’t believe Fairfax County VA is alone in this particular type of discrimination. We see it daily in news stories where judges are giving lax sentences to illegal aliens in hopes of not “burdening” them with ICE attention. They are very open about it from what I can tell. From DUIs to assaults, illegal aliens get lighter sentences than legal citizens.

In other news, BREAKING: Around 300 federal agents are carrying out raids in Los Angeles’ MacArthur Park — an area notorious for open drug use. Fox’s @MattFinnFNC reports 19 kgs of fentanyl, valued at around $8–$10 million, was already seized in a raid this morning.

Long overdue: illegals get charges tossed or pled down to nothing while Americans get the book thrown at them, especially for DUI.

The pinko prosecutors should be charged with Civil Rights violations, conspiracy for same, and because the law was broken to obstruct enforcement of immigration law, indicted for obstruction as well.

The problem will be finding a jury to indict and convict.

Many don’t get sentenced at all. They get released with charges dropped or if they get in front of a judge they get murder dropped to misdemeanor trespssing or some such and released.

I assume that since they have announced a formal investigation that they have emails or other written or audio evidence supporting the investigation.

Democrats are so sure of themselves that they put stuff like this in writing thinking everyone that sees it will agree with their position. Maybe some lowly clerk or secretary got tired of seeing outrageous discrimination, carefully documented each instance, and finally blew the whistle on the attorney.

Yesterday, governor Walz was bragging about pardoning an illegal alien felon who was being deported on the basis of the felony, a drive-by shooting, I think. By pardoning him, Walz claimed the felony has vanished and the deportation should stop.
