A panel of judges handed a setback this month to New Mexico auto dealers attempting to derail mandates requiring manufacturers to deliver more electric vehicles to the state.
The ruling by a three-judge panel of the New Mexico Court of Appeals means that the state remains on track to steadily increase the share of zero- and low-emission vehicles in new car showrooms between now and 2032.
For vehicle year 2027, which starts this year, the state mandate requires that electric vehicles comprise 43% of new passenger cars and light-duty trucks delivered to New Mexico. That requirement is set to increase by 8% annually to a maximum of 82% by 2032.
The state's auto dealers argue that the mandates are unrealistic given soft consumer demand for electric vehicles in New Mexico. State Motor Vehicle Division data show that electric vehicle sales comprised only 3.23% of the 90,516 vehicles sold in New Mexico in 2025.
Auto dealers also say that despite their loss in the state Court of Appeals, actions by Congress and President Donald Trump eliminated state EV mandates, throwing the issue to the federal courts, rendering the mandates unenforceable for now.
Michelle Miano, director of the New Mexico Environment Department's Environmental Protection Division, said the state mandate remains viable despite federal actions.
"That action by the federal government is currently being challenged by all of the states that are participating," Miano said. At issue is a procedural vote used by Congress to invalidate state mandates, she said.
Miano also said the state mandate falls on manufacturers, not dealers. "The requirement isn't on the dealers," she said. "It's on the auto manufacturers themselves when they make available new cars to New Mexico to be sold. It doesn't require an auto dealer to sell a certain percentage of electric vehicles."

No difference; if 43% of dealer deliveries are EV's they need to sell those to stay in business. After President Trump's administration eliminated a $7,500 federal subsidy for electric vehicles on Sept. 30, 2025, electric vehicle sales plunged from 4.6% of New Mexico vehicle sales in September to just 1.8% in December, according to state Department of Motor Vehicle registration data.
1.8 percent is a long way from 43%. People don’t want EV’s and the government can’t force them to buy them.
The three-judge NM Court of Appeals panel found that the federal Clean Air Act allows states to "piggyback" on California's standards as long as the rules were adopted at least two years before the mandates take effect. New Mexico adopted the rules two years before model year 2027 in compliance with federal law, the panel found.
Do Democrats have to take courses in “Advanced Science Inability” to do this?
When is the population going to revolt and give Dems the Mussolini treatment?
Hopefully, soon.
This is beyond laughing at, these folks are actively trying to bring us back to Muslim era civilization. No, wait....
Ain’t Communism wonderful.
AZ is just a quick drive away.
Stupid law written by morons.
“mandates”

The article misspelled “madness”.
Painfully stoopid. At least a couple places in NM where you might miss a charging station IIRC.
Especially true here in New Mexico with long miles between gas stations and even longer miles between EV charging stations. Ten minutes to gas up in Vaughn, hours to charge enough for the battery to get you the 96 miles to Roswell.
At least there’s plenty of room in NM to park all those unsold EVs.
communism works every where it is tried/s
At least the state is no longer forcing citizens to purchase buggy whips !

Don't forget Lubbock and even Dallas where you can get great deals. I went to a funeral in OK City last month, stayed a few extra days and drove back to Oil Patch City in a like-new Toyota P/U for a great price.
New Mexico has two kinds of stupid: red and green.
No Problem, FORCE every Public Employee to use EV’s for all travel and prohibit them from owning or using an ICE powered vehicle of any kind.
Used car dealerships will do very well. New Mexico’s watermelon Marxists will force the new car business out of New Mexico.
Then comes Cash For Clunkers II.
The NM judges do not understand “flooring.” Manufacturers charge the dealer interest every month on unsold new cars sitting on dealer lots. The interest charges on unsold EV’s will add up to a crushing burden. This WILL put new car dealers out of business in New Mexico.
Communists NEVER understand how the real world works.
