An exclusive Channel 2 Action News Investigation finds hundreds of Georgians arrested for DUI in 2025 later were proven to be sober by GBI blood tests.
In suspected DUI cases, the GBI tests samples for drugs only if they are found to be under the legal limit for alcohol.
Through an open records request, Channel 2 Action News Consumer Investigator Justin Gray obtained records showing that 701 people tested by the GBI in 2025 had no illegal or prescription drugs found in their system during toxicology screenings.

Smyrna resident Lenny Daniel is one of those.
“It’s a shame to be arresting innocent people like that who did nothing wrong,” Daniel said after Gray showed him the open records data.

n a November story, we showed how 19-year-old college student McClain Fineran was also arrested for DUI based on a field sobriety test.
After the kicker on the Shorter University football team blew .000 on a breathalyzer, Rome police suspected marijuana impairment and charged him with DUI after a fender bender in a college parking lot. Fineran had called police to the scene himself to report that he had hit a parked car.
“I don’t drink, never have. Haven’t done drugs, never had. It’s just not what I do. And he said well I have the suspicion that you have,” Fineran told Gray in November.
Both men, Fineran and Daniel spent the night in jail and were formally charged with DUI. In both cases, GBI blood tests eventually came back clean for drugs and alcohol.

You know that the cops were just looking for someone to arrest and didn't like the driver contradicting them.
Always refuse the field test. Blow or have blood drawn.
That is, if you’re actually sober.
Most people can’t perform the acrobatics required of the balancing tests and aren’t sharp enough under pressure to not make a mistake during the mental ones.
They need to be rewarded only for a conviction, and this will stop.
I’d be curious to know the races of both the victims and the cops.
It were the drunk drivers that were allowed to pass on by. I imagine they didn’t want to stop the drunk drivers for fear they would be a car load of their beloved illegal alien “neighbors.”

So they were charged, but not convicted... Lots of people behind the wheel of a car are just really bad drivers and shouldn’t be on the road. Their license should be taken away purely for stupidity.
The testing for a driver license is too simplistic and they give them out like popcorn at a theatre... I live in a downtown area and the amount of people who are incapable of parallel parking is astounding... Now they have cars that do it for you, but when I took my driver test parallel parking was a requirement... And I did mine in Pontiac Parisian four door... A boat by today’s car standards.

Alabama DUI laws are ridiculous. The cops here will put you in jail for DIP for no other reason than they think that your eyes look “red and glassy”. I wish I was joking.
The whole DUI “gig” is nothing but a cash cow to the towns/counties/state when they meet the #’s for getting federal monies for such interventions. Then factor in the towing /lawyer/bail/missed work/explaining to everyone(no one usually believes, policemen don’t lie) It is a NO WIN situation for the majority of the traffic stops with police...Also insult to injury, there is no avenue for an innocent person to recoup any of the monetary costs pertaining to a false arrest? So cops dont care/courts don’t care ...a true circle jerk that screws the average citizen and there is no way to avoid your $ leaving your hands.

That’s the truth. I can’t balance at all and would fail everyone. If the cop is asking you to do those tests, you are already going to jail. The tests are subjective, not objective. There is no way they are going to “pass” you. Also, always ask for a independent blood test (and have funds available to pay for it).
In Georgia, after submitting to the state-administered chemical test (breath, blood, or urine) following a DUI arrest, you have the right to request an independent chemical test of your blood, breath, or urine at your own expense. Officers must reasonably accommodate this request, including assisting in finding a facility and allowing transportation.
Field sobriety testing is subjective. Police doing traffic stops in a particular area in TN didn't use breathalyzers roadside, so the drivers, whom the officers determined were impaired, were taken in for blood draws. Unfortunately getting the results from the lab that was severely backed up and unable to turn the tests around in a timely manner, resulted in wait times of months. In the meantime, the drivers had to live with a DUI charge pending even though they knew they weren't impaired.
The problem with field sobriety testing is that some people have mobility/walking issues for different reasons, like hip and back problems, arthritis, prosthetic limbs. The police, at least in some areas, don't seem to care.
A number of people in TN are using lawyers at this point. One guy is suing the county for $400K.
I remember reading about the cases in TN. As said above, DUI arrests are mostly a cash cow for cities and counties. People lose their jobs, lose custody of children, and lose their reputation in the community due to false DUI charges and the cops just shrug and walk away free.

Wow. That’s huge! Here in Wisconsin you can pretty much trust that 3 out of 4 drivers actually ARE drunk and driving when you’re on the road after bar time!
It’s not unusual for people to rack up six DUIs...and they still keep driving drunk!
And it’s ridiculously EXPENSIVE! So, you’re a raging alcoholic who probably can’t hold down a job, but can afford $10K and UP for your offenses with court costs, lawyers, fines, etc.?

So far, we’ve been lucky but we have lost a local farmer to a drunk driver - she was out and about at 2pm in the afternoon on a week day! (Beau wrote a Victim Statement for the case).
Come on, LOSERS! Stay HOME and drink if you HAVE to! Yeesh!

This is a big problem especially with people who have some physical issues that cause poor balance.
