Woman sues Target for not hiring her because she has a pending robbery case

A Chicago woman with a pending robbery case is suing Target, accusing the retail giant of violating Illinois civil rights law by rescinding a conditional job offer after discovering her unresolved criminal case.

Courtney McElrath-Bey, 35, claims the company unlawfully used her background against her when it decided not to hire her for a warehouse position last year. Her lawsuit, filed in February and first reported by Legal Newsline, seeks damages and could expand to cover other applicants who were denied jobs under similar circumstances.

According to the complaint, Target extended McElrath-Bey a conditional offer in October for a job described as an “order picker or warehouse associate” contingent on the results of a background check.

The screening reportedly revealed pending criminal charges against McElrath-Bey and the company sent her what the lawsuit describes as a “Pre-Adverse Action Notification,” informing her that the background check had identified the unresolved charges.

In March 2024, prosecutors charged McElrath-Bey with robbery and aggravated battery, saying she was one of the offenders who mugged a 30-year-old woman in the 400 block of East 66th Street. She has pleaded not guilty and continues to fight the allegations in court.

She has a right to a speedy trial on the criminal charge. She should have exercised it.

Retail stores don’t hire thieves or likely thieves.

The fact that some lawyer took this case is a commentary on the state of the legal system in this country. When two armed men break into a home and the 85 year old grandmother shoots them, and the parents of the men sue the grandmother who has to go to court to defend herself, somethings way outta whack in the courts. (Fortunately, the grandmother won her case.)

For some reason I misread "warehouse", thinking that the peeps at Target just don't recognize talent when they see it.

The lawyer instigated the suit in an attempt to shake Target down for an out of court settlement.

One of the fatal flaws in Illinois leadership is that the state Senate districts are no longer based on geography, but population. In fact, each state Senate district contains 2 state House districts. As a result, the Senate changed from a break-even or Republican majority to a 2/3 democrat majority several years ago. So there is no adult supervision in the state anymore.

A few years ago, the state license plate was changed, and now only includes 1/2 of Abe Lincoln's face. I suppose the next one he will be gone entirely.

A lady ran into my truck and she got the ticket. It was obviously her fault.
Her insurance fixed my truck then she sues me for pain and suffering
I talked with a lawyer for my insurance company and she said they will probably give her some money for pain and suffering just to get rid of her

There are some cities where it is discrimination to not hire someone based on a pending criminal charge. Its crazy. Its yet another reason why businesses are fleeing certain city jurisdictions.

Not unexpected at all. The Democrats have never forgiven Old Abe for marching an army of Republicans into their states and taking away their slaves.
