Groups file brief in support of ending post-Election Day ballot counting

Four election integrity groups filed an amicus brief in support of a case that requests the U.S. Supreme Court not allow state laws that permit counting ballots arriving after Election Day, with experts saying that the recent normalization of late ballots negatively affects trust in and efficiency of elections.

Executive Director of Honest Elections Project Jason Snead told The Center Square that “this case is nothing more than a return to the norm and an enforcement of federal law against a novel scheme that illegally extends elections beyond Election Day.”

Late arriving ballots “[erode] confidence in the outcome,” and “mean that election results are delayed,” Snead said.

“We have seen long delays in declaring a winner and instances where late arriving ballots change the outcome,” Snead said.

Honest Elections Project was joined by the American Legislative Exchange Council (ALEC), the Center for Election Confidence (CEC), and Restoring Integrity and Trust in Elections (RITE) in filing the amicus brief in Watson v. Republican National Committee.

"Thirty-six states do not allow late ballots, and historically that has been the norm,” Snead said. “Of the fourteen that allow late ballots, half only began during COVID, an emergency that has long since ended.”

Another interesting case pending at SCOTUS.

Watson v. Republican National Committee.

Issue: Whether the federal election-day statutes, 2 U.S.C. § 7, 2 U.S.C. § 1, and 3 U.S.C. § 1, preempt a state law that allows ballots that are cast by federal election day to be received by election officials after that day.

Elections should be more important to the citizens than they are to the politicians. If the citizens care about the outcome they should vote on Election Day. If they don’t vote on Election Day, it’s a good indication that they don’t care enough about the outcome. Politicians care because of the power they get so they need as much time as they can to make sure they win.

Everyone knows when election day occurs, and they should be smart enough to mail in their ballot in plenty of time to have it counted.

CA took weeks to count and there’s no excuse for it.
They can’t even get their cheating done quickly.
I’ll never forget getting home late from work in Nov 2020 only to find that vote counting HAD STOPPED. It was like 1230 PM PST and we were in the middle of covid and I was really pissed because Trump was ahead when I left work….

After the 2020 election, the Democrats actually changed the US Code to allow for endless counting after election day.

Title 3 § 2 prior to December 29, 2022:

3 U.S. Code § 2. Failure to make choice on prescribed day

Whenever any State has held an election for the purpose of choosing electors, and has failed to make a choice on the day prescribed by law, the electors may be appointed on a subsequent day in such a manner as the legislature of such State may direct.

The Democrats repealed this statute after the January 6 2001 protests. Their bill did two things:

  1. Made it harder to challenge the Electoral College certificate from the states.

  2. Eliminated the power of state legislatures to appoint their own Electoral College members if the result of the vote was not determined on Election Day.

Especially when you consider that the networks are "updating" results every couple of minutes. Hmmmmmm.

If we don't have a lead in the House by 48 seats on Election Night, it's probably lost. California is going to spend the next four weeks hand collecting ballots, ensuring the Democrats win 48 of CA's 52 seats.

I watched as California took weeks to count (insert) ballots and then suddenly stop once the (D) candidate took the lead. The only way it could take weeks to count ballots is if fraudulent ballots were being added to the records. The left stole at least six (and maybe a dozen) seats in 2024.

I am so glad I am old. I hope my offspring can fix the democrat commie filth but I am not optimistic.

Florida is the model that every state should follow. Mail-in ballots are all counted but not made public until polls close, and no ballots are accepted after the polls close on Election Day. Wish this could be the national standard.

Ahh, I disagree. On time means on time. Commanders must ensure military members have their ballots and are mailed enough time in advance to get to the proper place several days before the ballot count.

The same applies to everyone.

My absentee ballot is mailed well over a month in advance and I return in within just a few days. There is no excuse for late mailings.

Okay...but if we see problems with many late arrivals...it has to be fixed.

My father was in WWII and I found what would constitute a proof of mailing of his ballot...or whatever it was...it confirmed that he voted in 1944 while at sea.
