Luigi Mangione will not face death penalty in UnitedHealthcare CEO killing, judge rules in blow to DOJ

Luigi Mangione won’t face the death penalty for allegedly executing UnitedHealthcare’s CEO, a judge ruled Friday — dealing an embarrassing blow to the Justice Department.

The 27-year-old still faces the possibility of life in prison without parole if convicted of executing health care honcho Brian Thompson in a December 2024 targeted hit on a Manhattan sidewalk.

But Manhattan federal Judge Margaret Garnett threw out the charges against Mangione that could have led to a rare death penalty trial in New York.

The jurist found that the death penalty-eligible parts of the case, brought by the US Attorney’s Office for the Southern District of New York, had “legal infirmities,” according to her ruling.

The judge noted that the “chief practical effect” of dismissing that portion of the indictment is “solely to preclude the death penalty as an available punishment when the jury determines if the Defendant caused Brian Thompson’s death.”

The blow to federal prosecutors comes months after US Attorney Pam Bondi announced that the government would take the rare step of seeking the death penalty against Mangione, who has pleaded not guilty.

Federal Judge Margaret Garnett was recommended by Schmucky Schumer and nominated to serve as a federal district judge by Biden in 2023.

Why is it a blow to this administration. It is a blow to justice. When you stalk a target then walk up and shoot them from behind why does that not warrant execution. The justice system is broken.

This is not a “blow” to the DOJ by a skanky, female, weaponized Democrat “judgette”. It was a blow to innocent people of America walking the streets of our collapsing country. Her commie ass needs to be locked up in Alligator Alcatraz until she’s deported.

Guess I need to be reminded why/how this became a federal case. Is it because Mangione crossed state lines to commit murder?

The people do not support the death penalty, unless it is done in semi-secret in a bizarre and disgusting imitation of an ER trauma room or an ICU bed.

If people won’t tolerate it except under these conditions, it should be abolished.

I can’t figure this one out. Sounds to me that the judge is saying that shooting someone in the back of the head doesn’t meet the statutory requirement for a “crime of violence”. Then again, this is Manhattan and that Hudson River water does some weird stuff to people.
