Appeals court reverses decision that freed pro-Palestinian activist Mahmoud Khalil

A federal appeals panel on Thursday reversed a lower court decision that released former Columbia University graduate student Mahmoud Khalil from an immigration jail, bringing the government one step closer to detaining and ultimately deporting the Palestinian activist.

A three-judge panel of the 3rd U.S. Circuit Court of Appeals in Philadelphia instructed the lower court to dismiss Khalil’s habeas petition, a court filing that secured his release. The panel ruled that the federal district court in New Jersey did not have jurisdiction over the matter because immigration challenges are handled differently under the law.

The 2-1 ruling concluded that Khalil needed to channel his complaint through immigration courts and ultimately to the court of appeals — the standard process for immigration challenges — rather than take a habeas petition to district court.

More than likely his lawyers knew this. They also knew they had a better chance in district court with a leftist jurist.

I know its always tempting to want Trump to tell these activists judges to piss off and ignore their ridiculous rulings but if he doesnt play by the rules he is no better than them.

They always find some activist judge to block Trump’s actions.
The media dutifully report on this decision.
It is always (almost) overruled by the appellate or supreme courts, but it delays the proceedings, costs taxpayers $ and the appellate decisions are not that much reported, so in (some) media Trump looks like somebody making all kind of illegal actions.
I think, this propaganda values of activist judges “decisions” may be their biggest value for the left.

“see, Trump is fascist dictator” reporting messes up many people, who are not that much into politics.
They just heard all kind of Trump actions being stopped by judges, and do not understand that the judges are the “fascist dictators”.

It’s too bad that we don’t have a law that removes lower court judges from their job when they are overturned above a certain threshold percentage of times

It was a feature..not a bug.

These judges were appointed to wreak havoc on our laws and constitution. One of the judges Biden appointed had only been a U.S. citizen for 5 years. He knows nothing of our laws and Constitution.
